Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply. These include specified convictions involving organised crime, corruption, fraud, terrorism, money laundering, unlawful employment or exploitation of foreign workers, illegal child labour or human trafficking; outstanding tax, social security or environmental charges; and applicable international sanctions. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations, insolvency or similar circumstances, serious professional misconduct, anti-competitive conduct, an unmanageable conflict of interest or distortion of competition, serious or persistent failure to perform previous public contracts, false or misleading information, certain tax offences, or lack of the right to submit a tender. Companies based in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 275,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts showing turnover for those years, unless the information for an Estonian-registered legal entity is publicly available to the contracting authority. At least six months must have passed since the end of the most recently completed financial year by the tender submission date.
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the contract being procured. At least one must have a value of EUR 80,000 or more excluding VAT. Provide a list stating the performance period, the other contracting parties’ details (including a contact person’s telephone number and email address) and, for public contracts, the procurement reference numbers. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bidder must have an employee with switching rights for work-related switching operations in a 0.22–20 kV electricity network, including operational switching, isolation and earthing, re-energisation and restoration of the normal network configuration; regional and distribution substations are excluded. The employee must be registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person responsible for the work operation, registered in that portal before tenders are opened. Electrical work must be led by a person with valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act; the person must hold the relevant evidence by the tender submission date and be registered in the portal before tenders are opened.
The tender must comply with all procurement-document requirements; conditional tenders and tenders containing additional conditions are not permitted. Submit the price using the prescribed table and complete every unit-price field. Provide the contract signatory’s name, position and contact details, evidence of authority to sign if it does not arise from the articles of association, and a contact person for contract matters. Identify any claimed trade secrets and explain why they qualify, or state that the tender contains none. The bidder must confirm that its place of residence or establishment is not in Russia or Belarus. Materials, equipment and goods, including components, installed or used during the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. Standard payment periods are 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
