Compliance requirements
A bidder will be excluded from the procurement if any exclusion ground set out in section 95(1) of the Estonian Public Procurement Act applies. Before contract award, the contracting authority will verify that the successful bidder is not subject to these grounds and may require supporting evidence where necessary.
Qualification criteria and exclusion grounds
Where required by the law of the bidder’s country of establishment, the bidder or each member of a joint bid must be registered in a commercial or equivalent register. A copy of a valid registration certificate must be provided; if registration is not legally required, a copy of the founding document or an equivalent document must be submitted. The contracting authority will verify the details of legal entities registered in Estonia.
During the 36 months preceding the start of the procurement, the bidder must have completed similar contracts with a combined value of at least EUR 20,000. The bidder must provide a list of completed contracts, including their values, signature dates and details of the other parties, using Form 4 of Annex 2 to the procurement documents.
The bid must include the declaration in Form I of Annex 2, containing at least the bidder’s details, the confirmations and bid information required by the form, and the bid validity period. The bid must remain valid for at least 3 months. Joint bidders must appoint an authorised representative and provide the original power of attorney granted to that representative. If the signatory’s authority to represent the bidder is not shown in the registration certificate, a power of attorney confirming that authority must be included.
The bid must include the technical description using Annex 3, including a web address providing the proposed device’s technical specifications and information and confirmations demonstrating compliance with all technical requirements. The bidder must confirm compliance with the procurement documents and, where relevant, explain equivalence and provide supporting evidence.
The bidder must be the manufacturer’s official sales and warranty partner in Estonia for the products offered. Evidence of this status and a description of the maintenance and warranty system must be submitted.
The products must carry a warranty of at least 36 months, starting upon handover. The warranty must cover repairs and the provision of a replacement product during warranty repairs, including battery defects, and ensure that the products meet the contract specifications at no additional charge.
Prices must follow the prescribed structure and state the price per device and the total price for the devices. The total price must include transport, installation and all other costs necessary to perform the contract. The bidder must identify and justify any information in the bid claimed as a trade secret; the bid price and figures used to assess the award criteria may not be designated as trade secrets.
