The bidder must confirm that neither the bidder nor its management or supervisory board members, representatives, decision-makers or controlling persons have, during the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour or human trafficking-related offences. The bidder must also have no outstanding tax or social security payment obligations and must not have enabled an illegally staying foreign national to work or paid wages below the statutory rate. The bidder must confirm that entering into the contract would not breach an international or Estonian sanction and that the bidder, any joint bidders and any entities whose capacities are relied upon are not established or resident in Russia or Belarus. Where applicable, the bidder must provide information on convictions, tax or social security debts, authorised persons and measures taken to restore reliability; the contracting authority may request additional evidence.

The machine-readable tender passport does not specify precise turnover, previous experience, staffing or other qualification requirements; these must be checked in the tender documents. The bidder must submit a tender complying with all procurement documents and must include in the tender price all works and volumes required by the technical description. The tender must include the participation application in Form 2, including subcontractor details and a list of documents containing trade secrets, with reasons for their classification. If the tender is submitted by a person without authority to represent the bidder, a written power of attorney must be provided. Joint bidders must appoint a representative from among themselves and submit the power of attorney and confirmation of joint and several liability in accordance with Form 8. The bidder must confirm that the tender complies with the procurement documents; where a standard, technical solution, label or other reference is specified, an equivalent solution may be offered, but its equivalence and supporting evidence must be explained and submitted where necessary. The goods offered must not be subject to an international sanction or originate from a sanctioned region. The tender must include a price form prepared by the contractor, which will later be used as the basis for certifying the works. For verification purposes, the bidder must also provide the names and identification details of authorised persons who are not shown in the commercial register or an equivalent register, or confirm that no such persons exist.
