Purchase and installation of furniture and small equipment for Tallinn schools under the project "Implementing the principles of inclusive education in the period 2021–2027"

The bidder must confirm that neither the bidder nor its management, administrative or supervisory board members, representatives or controlling persons have received a final criminal conviction during the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, child labour or other forms of trafficking in human beings. The bidder must also have no outstanding tax or social security payment obligations. If such obligations have been breached, the bidder must explain the circumstances and show that the obligations, including any applicable interest and late-payment charges, have been paid or covered by a binding agreement. The notice sets the threshold for tax and social security debt at EUR 0; the tax authority does not issue a certificate where the debt is below EUR 100 or payment has been deferred. The exclusion grounds also cover bankruptcy, insolvency or liquidation proceedings, assets managed by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious previous contract breaches or early termination, and the submission of false information or failure to provide required documents. Compliance with environmental, social and labour-law obligations is also checked. The bidder must confirm that it is not subject to international sanctions and that no exclusion ground applies concerning the employment of an unlawfully residing foreign national. Where an exclusion ground exists, the contracting authority may, where permitted, require a description and evidence of measures taken to restore the bidder’s reliability.

The bidder must have completed at least one contract during the 36 months preceding the start of the procurement for the sale and installation of furniture and products similar to the subject matter of this tender, with a value of at least EUR 50,000 excluding VAT. The tender must include a list of such contracts stating their value, contract dates, details of the other contracting parties, the client’s contact person, email address and telephone number, and the reference number where the contract was a public procurement contract. The bidder must submit a compliant tender, confirm acceptance of all tender-document requirements, and provide prices in euros excluding VAT, to two decimal places, using the required structure and the forms in Annex 3. Unit prices and the total price must include all costs necessary for proper contract performance; zero or negative prices are not permitted. Where relevant, explanations and evidence of equivalence must be provided. In a joint tender, a power of attorney for the joint tenderers must be included. Any trade secret must be identified and justified; the tender price and figures characterising the tender for evaluation purposes may not be classified as trade secrets. The bidder must confirm that it will not use, for more than 10% of the contract value, sanctioned Russian individuals or entities, entities controlled by them, or subcontractors or suppliers acting on their instructions. The goods offered must not be subject to international sanctions or originate from sanctioned regions, and the bidder must confirm compliance with anti-corruption requirements. Wood used to manufacture the furniture must come from legal sources; product-specific evidence, such as an FSC, PEFC, CSA or SFI certificate or a FLEGT or CITES licence, or equivalent evidence, must be provided upon delivery. REACH candidate substances present above 0.1% by mass must be declared, with safety data sheets, declarations of conformity or a manufacturer’s statement provided upon delivery. The furniture must be capable of being dismantled without damage and repaired using hand tools, and dismantling and repair instructions must be supplied. The warranty must be valid for at least two years from delivery, and spare parts or functionally equivalent elements must remain available for at least two years after delivery.
