A bidder must be excluded if the bidder or a relevant management, supervisory or representative person has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; unlawful employment of a foreign national or violation of employment conditions, including underpayment; unlawful use of child labour; or trafficking in human beings. The bidder is also excluded if it has outstanding state taxes, duties or environmental charges, or unpaid tax or social-security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or persistently breached an important condition of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty. Exclusion may also apply where the bidder has submitted false information concerning compliance with qualification requirements or failed to provide required information or additional documents. Participation is not permitted for enterprises established or resident in the Russian Federation or the Republic of Belarus. Materials, equipment, goods and components originating from or produced in those countries may not be installed or used during performance; the contracting authority may request certificates of origin.

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the start of the procurement. At least one of these contracts must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and the procurement reference numbers where applicable. At the contracting authority’s request, evidence of proper performance must be provided unless the information can be obtained from public or private databases without significant expense. The bidder must have a person with valid switching rights for work-related switching operations in the 0.22–20 kV electricity network. The person must be registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage-only works, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including where medium-voltage-side switching is needed for low-voltage works. The bidder must have a person responsible for the work operation, registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person managing electrical works with valid A-level competence and/or a qualification corresponding to at least level 6 under the Vocational Qualifications Act, supported by the relevant evidence and registered in the partner portal before tenders are opened. The tender must include a price table in the required format, with all unit-price fields completed. The bidder must provide the name, position and contact details of the contract signatory or signatories and a contract-performance contact person. If signing authority does not arise from the articles of association, a power of attorney must be submitted. The bidder must also confirm compliance with all procurement-document requirements; conditional tenders or tenders containing additional conditions are not permitted.
