The bidder must confirm that neither the company nor its management, supervisory-board members, authorised representatives or other persons able to control or represent it have been convicted within the relevant period of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also not have outstanding tax or social-security obligations, subject to the rules stated in the notice; the tax-authority certificate exception refers to debt below EUR 100 or an officially deferred tax debt. Other exclusion grounds include breaches of environmental, social or labour law, bankruptcy, insolvency or liquidation, agreements with creditors, similar domestic situations, assets managed by a liquidator or court, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement that creates an unavoidable competitive advantage, serious or repeated failures in previous public contracts, and false or omitted information or failure to provide requested documents. The bidder must also confirm that entering into the contract would not breach international or Estonian sanctions and that it has not enabled an unlawfully staying foreign national to work or paid below the legally required wage. Where an exclusion ground may apply, the bidder may need to describe the circumstances, provide evidence and, where permitted, demonstrate remedial measures restoring its reliability.
