Compliance requirements
The tenderer may be excluded for relevant final criminal convictions involving the tenderer or its management, supervisory bodies or authorised representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The grounds also include unpaid taxes or social security contributions, offences involving the employment of a foreign national without legal grounds or in breach of employment conditions, and the possibility that awarding the contract would violate an international or Estonian government sanction. The notice explains that a tax-debt certificate may not be issued where the relevant debt is below EUR 100 or payment has been deferred. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The tenderer must have duly completed at least two restoration or reconstruction projects during the five years preceding the procurement. At least one project must have involved a heritage-protected building or an object of cultural value, and at least one contract must have been worth at least EUR 75,000 excluding VAT. The tenderer must provide details of both references, including a description, period, contracting authority and contract value, and evidence that the work was properly completed.
The works must be managed by a project manager who, by the tender submission deadline, has at least one project in the preceding five years managing renovation construction works on a heritage-protected or culturally valuable building as the contractor’s project manager. The offer must include the project manager’s CV. If the manager is not directly employed by the tenderer, include their signed confirmation that they will actually participate in performing the contract; the contracting authority may verify the reference with its client.
The offer must follow the required pricing structure and include the unit-price schedule using Annex 2. Conditional offers are not permitted. Joint tenderers must appoint an authorised representative and provide the relevant authorisation. The tenderer must confirm compliance with the procurement documents and provide evidence of equivalence where applicable.
