Compliance requirements

Mandatory exclusion grounds include relevant convictions of the bidder or its representatives for organised crime, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals, child labour or human trafficking; outstanding tax, social security or environmental payment debts; and circumstances in which awarding the contract would breach international or Estonian government sanctions. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; insolvency, liquidation or suspension of business; serious professional misconduct; anti-competitive conduct; an unmanageable conflict of interest or an advantage arising from involvement in preparing the procurement; serious or repeated breaches of previous public contracts; false or misleading information or failure to provide requested evidence; attempts to improperly influence the contracting authority or obtain confidential information; certain tax offences; or lack of legal entitlement to submit a bid. The bidder must confirm that no applicable exclusion grounds exist. Participation is prohibited for enterprises domiciled or established in Russia or Belarus.

Qualification criteria and exclusion grounds

The bidder’s net turnover in its most recently completed financial year must be at least EUR 200,000 and must have been generated in business areas corresponding to the subject of the contract. At least six months must have elapsed between the end of that financial year and the bid submission date. The bidder must provide an extract from its annual report showing net turnover, unless the information is publicly available to the contracting authority in a register for a bidder registered in Estonia. If the financial year does not coincide with the calendar year, the requirement applies to the most recently completed financial year. During the 36 months preceding the start of the procurement, the bidder must have properly completed at least two contracts for mowing services and one contract for snow clearance. Submit a list of these contracts using Form 2, Information on Previous Contracts. The bid price must be submitted using Form 3 in Excel format. Do not change the positions or quantities in the pricing table; indicative quantities are estimates and are not binding on the contracting authority. The bidder must join Elektrilevi’s Partner Portal (EPP) before contract performance and use it during the framework agreement. Joint bidders must appoint an authorised representative and provide a power of attorney. The bidder must also confirm that it is not established or domiciled in Russia or Belarus, that prohibited Russian-linked subcontractors or suppliers will not account for more than 10% of the contract value, and that goods and auxiliary materials used in performance are not subject to international sanctions or from sanctioned regions.
