Compliance requirements
A tenderer may be excluded if, within the previous five years or while an exclusion period remains in force, the tenderer or a member of its administrative, management or supervisory body, or a person authorised to represent, make decisions for or control it, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence or related activity, money laundering or terrorist financing, child labour or another form of human trafficking. Where permitted for this procurement, the tenderer may provide evidence of measures taken to restore its reliability.
Exclusion also applies if the tenderer has failed to meet tax or social security contribution obligations in its country of establishment or the contracting authority’s country. The stated threshold is EUR 0. The notice explains that the Estonian Tax and Customs Board does not issue a tax-debt certificate where the total debt it administers is below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled. For a foreign tenderer, the tax-debt certificate is issued under the law of its country of establishment. A tenderer may also be excluded if entering into the contract would breach an international or Estonian government sanction.
Qualification criteria and exclusion grounds
For each lot bid for, the tenderer must submit the completed unit-price table by the submission deadline. Every product must have a unit price in euros excluding VAT, stated using the table’s unit of measure, and a link to that specific product in the tenderer’s e-ordering system. The prices are binding for orders under the contract. The price offer must follow the structure specified in the tender documents; conditional bids are not permitted.
For Lot 1 (office supplies), copy and drawing paper must carry the EU Ecolabel or an equivalent EN ISO 14024 Type I ecolabel linked to the paper manufacturing process. If the paper has no such label, submit a conformity audit from a conformity assessment body or independent auditor confirming that it meets the relevant ecolabel criteria. The tenderer must confirm that the primary wood fibre used to produce the pulp comes from a legal source. Evidence of the wood’s origin must be provided when the paper is delivered; examples include a producer’s declaration, FSC certificate, FLEGT document or CITES licence. For uncertified primary wood fibre, specify the fibre types, quantities and origins, confirm their legality, and ensure traceability through the entire production chain from forest to finished product.
The paper producer must operate an ISO 9001, ISO 14001, EMAS or equivalent internationally recognised quality or environmental management system. Provide the producer’s details and the relevant certificate. For an equivalent system, provide a conformity audit from a conformity assessment body or independent auditor confirming that it substantially meets the relevant ISO 9001, ISO 14001 or EMAS criteria.
Joint tenderers must appoint an authorised representative from among themselves and include their power of attorney with the bid. The tenderer must confirm that the bid meets the tender-document requirements and provide an explanation and evidence of equivalence where applicable. Offered goods must not be subject to international sanctions or originate from sanctioned regions.
