Compliance requirements
The bidder must confirm that neither the bidder nor its representatives have, within the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, illegal child labour or human trafficking. The bidder must also have no outstanding taxes or social security contributions, bankruptcy or liquidation proceedings, suspended business activity, serious breaches of professional conduct, environmental, social or labour law, or agreements restricting competition. The declarations also cover conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, false statements, failure to provide required documents, and attempts to obtain confidential information. The bidder must further confirm that contract award would not breach international or Estonian sanctions and is not connected with employing a foreign national without a lawful basis. The threshold for tax debt is EUR 0; the tax authority does not issue a certificate where the tax debt is below EUR 100 or payment has been deferred. Where an exclusion ground applies, the bidder may submit evidence of remedial measures restoring its reliability where applicable.
Qualification criteria and exclusion grounds
The bidder must have the right to represent and sell the offered products in Estonia. This must be evidenced by a document or copy issued by the manufacturer, or, where the manufacturer is outside the European Union, by the manufacturer’s authorised representative; any further authorisations must also be provided. The bidder must have a product representative who has received manufacturer training or completed training on the products concerned. The representative’s name must be stated in the European Single Procurement Document, and, upon request, copies of training certificates or written confirmation from the manufacturer must be submitted. This requirement applies to all nine lots. The tender must include the Excel-based technical offer in Annex 1, specifying the exact product names, manufacturer, product code or reference number, descriptions, actual parameters, unit prices and total price per lot. Prices must be stated in euros to two decimal places and must include delivery, unloading and relevant training; unit prices must be final. Products must comply with the technical specifications, bear the CE marking and be placed on the market under Regulation (EU) 2017/745 or its transitional provisions. The bidder must provide manufacturer-issued technical specifications, instructions for use, materials proving compliance, and copies of applicable conformity certificates or declarations of conformity. The bidder must also submit proof of the right to sell in Estonia, management-approved transport procedures or an extract, and one sample in original packaging for each offered product, except for products used by the contracting authority under a contract during the previous three years. Samples must be delivered by the tender deadline to L. Puusepa 8, Tartu, and will not be returned. The contracting authority may request additional samples, which must be delivered within three working days. Conditional tenders are not permitted. For a joint tender, a power of attorney and confirmation of joint and several liability must be submitted using Annex 4, Form I, and all bidders must submit the participation declaration using Annex 4, Form II.
