Compliance requirements

The tenderer must confirm that neither the tenderer nor its management, administrative or supervisory body members, representatives or controlling persons have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, unlawful use of child labour or human trafficking-related offences. The tenderer must also have no outstanding tax or social security payment debts. The exclusion grounds also cover breaches of environmental, social and labour law obligations; bankruptcy, liquidation or another insolvency situation; an arrangement with creditors; assets being managed by a liquidator or court; suspended business activities; serious professional misconduct; agreements restricting competition; conflicts of interest; improper involvement in preparing the procurement; and serious or persistent breaches of previous public contracts. A tenderer may also be excluded for submitting false information, failing to provide required information or documents, improperly influencing the contracting authority or obtaining confidential information. The contracting authority will additionally check breaches concerning the employment of unlawfully staying foreign nationals in Estonia, international sanctions, convictions for tax offences and the tenderer’s legal eligibility to participate. Where applicable, a tenderer may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

Within the 36 months preceding publication of the contract notice, the tenderer must have completed at least one design contract as the main contractor for a public-use building. The building must have had at least 1,500 m² of enclosed net floor area and must not have been an industrial or warehouse building. The design work must have concerned either a new construction or a reconstruction project carried out at least to the detailed design stage. The ESPD must state the contract subject, contract validity period, net floor area of the designed building or relevant part, contract value, the tenderer’s scope of responsibility, and the client’s name and contact details. For a public contract, the relevant public procurement reference number must also be provided. Before submitting a tender, the tenderer must visit the place of contract performance at a time designated by the contracting authority and confirm the visit by signing with the contracting authority. Advance registration was required at argo.miller@saaremaavald.ee; the dates stated in the contract notice are 22 and 24 September at 14:00, with a third date to be arranged if necessary. For a joint tender, a power of attorney from the joint tenderers must be attached. The tender must comply with all tender documents; conditional tenders are not permitted. The price must be submitted in the required structure, and any equivalent solution must be explained and supported by evidence. The tenderer must identify and justify trade secrets; the tender price and numerical figures covered by the award criteria may not be designated as trade secrets.
