Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members or representatives have, during the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the illegal use of child labour or human trafficking-related offences. The payment of taxes and social security contributions is also checked; the notice describes a EUR 100 threshold and an exception for deferred tax debt. The exclusion grounds also cover bankruptcy or liquidation, insolvency proceedings, suspended business activities, serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement procedure, serious breaches of previous contracts, false information or failure to provide required information and documents, and breaches of environmental, social or labour law obligations. The bidder must also confirm that no national exclusion grounds apply concerning the employment of unlawfully staying foreign nationals, international sanctions or tax offences. Where an exclusion ground exists, evidence of remedial measures may be submitted if the procurement exceeds the international threshold or the tender documents allow this.

Qualification criteria and exclusion grounds

The bidder’s annual net turnover must have been at least EUR 100,000 in each of up to the three financial years completed before the start of the procurement procedure. If the undertaking has operated for fewer than three financial years, the requirement applies to each available financial year. Where the financial year follows the calendar year, turnover data for 2025, 2024 and 2023 must be provided. The tender must comply with all tender document requirements and conditional tenders are not permitted. The bidder must submit a technical description of the proposed storage solution specifying the manufacturer, models and architecture, together with technical documentation or equivalent evidence demonstrating compliance. The storage solution must have a raw capacity of at least 600 TB, equal to 600,000,000,000,000 bytes. The total tender price excluding VAT must follow the required structure and must not exceed EUR 300,000. The supplied equipment must have a five-year manufacturer’s warranty: critical faults must receive a response no later than the next working day, and commonly failing components such as hard drives and memory must be replaced by the following working day. A manufacturer’s confirmation must be provided. If an equivalent solution or evidence is offered, its equivalence must be explained and supported by evidence. In a joint tender, a power of attorney for the joint tenderers must be included. The bidder must identify and justify any trade secrets; the tender price and prohibited numerical data relating to evaluation may not be classified as trade secrets. During contract performance, subcontractors or suppliers that are Russian citizens, residents or entities established in Russia, or entities connected with them, may not account for more than 10% of the contract value. First-tier subcontractors must submit a European Single Procurement Document.
