Compliance requirements
Exclusion may apply where the bidder or a person in its management or supervisory bodies, or authorised to represent or control it, has a relevant final conviction within the previous five years, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking. Other grounds include tax or social security contribution arrears; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, court or liquidator administration of assets, suspension of business, or a similar situation; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unremediable competitive advantage; significant or repeated failure under an earlier public contract resulting in termination or comparable sanctions; and false or misleading information, omission of required information or documents, or improper attempts to influence the procedure or obtain confidential information.
National grounds also include enabling a foreign national to work without a lawful basis or in breach of applicable employment conditions, being subject to an international sanction, and conviction for tax offences. A bidder may be excluded where entering into the contract would breach an international or Estonian government sanction. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
