Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members or representatives have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, illegal child labour or human trafficking offences. The bidder must also have no tax or social security debt, bankruptcy, liquidation, insolvency proceedings, suspended business activity, serious professional misconduct, anti-competitive agreements, unavoidable conflict of interest or material breaches of previous public contracts. The bidder must provide truthful and complete information and submit all required documents. The notice also identifies exclusion grounds relating to enabling an unlawfully present foreign national to work, being subject to an international sanction, convictions for tax offences, local tax debt owed in the contracting authority’s area and statutory restrictions on participation. Where permitted by the applicable rules, the bidder may in certain cases submit evidence of remedial measures restoring its reliability.

Qualification criteria and exclusion grounds

The bidder must have completed at least two general building-cleaning contracts during the 36 months preceding the start of the procurement, each worth at least EUR 50,000 excluding VAT. The ESPD must include a list of the contracts, their values, dates and the other contracting parties. The contracts must demonstrate experience using cleaning products carrying the EU Ecolabel for hard-surface cleaning or an equivalent Type I ecolabel under EN ISO 14024. The bidder must prove equivalence; if no ecolabel is available, a conformity audit or other supporting document must be submitted. The site manager must hold at least a level 4 professional certificate for a cleaning services supervisor or an equivalent qualification, have at least three years of experience in building-cleaning services, and have experience organising and managing cleaning work at at least one similar site. The site manager must have Estonian language skills of at least level B1 and be able to communicate with the contracting authority in Estonian. The site manager’s CV must be included. The tender must contain a service delivery plan and work schedule complying with the technical description. The bidder must confirm acceptance of all tender-document conditions; conditional tenders are not permitted. The price must be submitted in the required structure, include all costs necessary for contract performance, remain final throughout the contract period, and may not be zero or negative. A power of attorney for the authorised representative must be submitted in the case of a joint tender. The bidder must also submit a list of the cleaning products to be used and documents proving their compliance. All cleaning products must meet EU Ecolabel criteria 1 and 4 for hard-surface cleaning products; an ecolabel certificate is sufficient where the product carries the EU Ecolabel, otherwise a conformity audit must be provided. Before service commencement, the bidder must provide environmental training to the service personnel and submit evidence of the training. During contract performance, monitoring must be carried out for at least one full working day at least once every four months, with records kept on cleaning products, equipment, water use and waste. Instead of establishing the monitoring procedure, the bidder may submit evidence of an ISO 14001-certified or EMAS-registered environmental management system, or an ecolabel certificate for indoor cleaning services.
