Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it, or its management, supervisory or representative persons, has been convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The declaration also covers relevant tax and social security payment defaults, breaches of environmental, social or labour obligations, insolvency or liquidation, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious failures under previous contracts, and false or misleading information, omissions or failure to provide requested documents. Where an exclusion ground applies, evidence of measures taken to restore reliability may be provided where permitted. The bidder must also declare whether the national grounds apply, including enabling the unlawful employment of a foreign national, being subject to international sanctions, relevant tax offences, local tax debt where applicable, or being ineligible under the bidder-location restrictions. Participation is not permitted for entities located in Russia or Belarus. Tax and social security obligations must be fulfilled; the notice explains that a tax debt below EUR 100 or a debt whose payment has been deferred is treated differently under the applicable rules. For first-tier subcontractors added during contract performance, the contractor must submit them for approval and exclusion-ground checks. A subcontractor with an applicable exclusion ground must be replaced if the contracting authority so requires.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least 2 similar public-space construction or reconstruction projects during the 60 months preceding the start of the procurement. Each project must have covered an area of at least 5,000 m² and involved a publicly accessible park, town square, playground or sports ground, including construction of paths, playgrounds and landscape architecture. The bidder must describe the work, completion period and client, and provide the client’s contact details; supporting evidence of proper completion may be requested. Planting must be carried out or supervised on site by a specialist responsible for the quality of the plants and proper execution of the planting works. The specialist must hold one of the specified equivalent qualifications: Gardener, level 4, with the relevant planting-area competency; Master Gardener, level 5, with the relevant planning, construction and maintenance competency; or Landscape Gardener, level 4, with the relevant planting and garden/green-area maintenance competency. For qualifications acquired abroad, provide evidence of recognition where required. The bidder must have an ISO 9001 quality management system and an ISO 14001 environmental management system for construction works, or equivalent certified systems. Confirm their availability and be prepared to provide valid certificates or acceptable equivalent evidence when requested. The bidder must confirm that the offer complies with the procurement documents, is unconditional and includes all costs required to perform the contract. Submit the price in the required detailed form and registry form in euros, excluding VAT, to two decimal places; complete all required price lines, and do not enter zero or negative prices. If proposing equivalent inventory or lighting products, complete and include the required equivalence table and supporting evidence. The bidder must also provide the required confirmations concerning subcontractors, the bid team, and—if submitting a joint bid—the representative’s power of attorney. The detailed team requirements are set out in the technical description.
