Compliance requirements

The bidder and first-tier subcontractors must confirm that no grounds for exclusion apply to them. The checks cover, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, the use of child labour or other forms of human trafficking, unpaid taxes or social security contributions, breaches of environmental, social or labour law, bankruptcy or other insolvency situations, serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, and the submission of false information or failure to provide required documents. The procedure also checks international sanctions, enabling illegal employment of a foreign national residing in Estonia, tax offences and local tax debt owed in the contracting authority’s area. For tax and social security debts, the threshold is EUR 0; a tax-debt certificate is not issued, among other cases, where the debt is below EUR 100 or payment has been deferred. The bidder must confirm that it will not use a subcontractor who would have to be replaced because of an exclusion ground. First-tier subcontractors must submit a European Single Procurement Document and the confirmation in Annex 3 that the exclusion grounds under Section 95(1), points 1–5 of the Estonian Public Procurement Act do not apply.

Qualification criteria and exclusion grounds

The bidder must engage one or more security systems designers for the design work, holding a valid level 6 professional certificate and competence in both fire detection system design and emergency lighting design. Where several designers are used, their combined competence must cover both areas. The fire emergency response plan and evacuation diagrams must be prepared by, or under the responsibility of, a level 5 fire safety specialist or a level 6 fire safety expert. The same specialists must be listed in the European Single Procurement Document and in the tender. If a specialist is not directly employed by the bidder, the tender must include that person’s digitally or handwritten signed confirmation of actual participation in contract performance. Before submitting a tender, the bidder must inspect the site in person after agreeing the time in advance with the contracting authority’s contact person, Jannu Kuusik, at jannu.kuusik@tallinnlv.ee; a bidder that has not inspected the site is not entitled to submit a tender. The tender must comply with all procurement documents, conditional tenders are not permitted, and the tender price must follow the prescribed structure. Where relevant, equivalence must be explained and supporting evidence submitted. Joint bidders must submit a power of attorney. The bidder must identify and justify any trade secrets, but may not classify the price or numerical figures corresponding to the award criteria as trade secrets.
