Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that no mandatory exclusion grounds apply. These include relevant convictions of the bidder or its representatives for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal employment of foreign nationals, child labour or human trafficking; unpaid taxes, duties or environmental charges or social security contributions; and circumstances in which awarding the contract would breach international or national sanctions. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; insolvency or similar circumstances; serious professional misconduct; anti-competitive agreements; unmanageable conflicts of interest or an unfair advantage arising from involvement in preparing the procurement; serious or persistent failure to perform previous public contracts; false or misleading information or failure to provide requested information; attempts to improperly influence the contracting authority or obtain confidential information; certain tax offences; or lack of the legal right to submit a bid. Companies established in Russia or Belarus may not participate. The bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, entities more than 50% owned by such persons or entities, or persons acting on their behalf or under their direction. The bidder must confirm that goods and auxiliary materials used for the contract are not subject to international sanctions and do not originate from sanctioned regions.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 100,000 in each of the three most recently completed financial years. The turnover must relate to engineering and related technical consultancy, construction engineering design and consultancy, other engineering activities, or construction of electricity and telecommunications networks, or equivalent fields. The final completed financial year must have ended at least six months before the bid submission date. The bidder must provide extracts from the three annual reports showing the turnover, unless the information is publicly available to the contracting authority; non-Estonian bidders must use the corresponding NACE classification. The contracting authority may request an explanation if the relevant turnover is not shown under the stated activity codes. The bidder must submit a list of reference projects completed during the 60 months before the procurement began, using Form 2. The provided document does not specify a minimum number or further details for these references. At least one person performing the framework agreement must hold a valid level 7 electrical engineer qualification in electrical networks and systems, with design as the selected area of work, or equivalent A-level competence. Evidence of the person’s valid qualification or competence must be submitted. The bidder must submit the price form using the prescribed coefficient, which is used to calculate unit prices and the total bid price from the contracting authority’s tax-exclusive base prices. The indicated quantities are estimates and are not binding. The price table’s positions and quantities must not be changed, and the form must be submitted in Microsoft Excel format. The bidder must also be prepared to use the contracting authority’s electronic schemes, databases, software and environments, including Trimble Unity and EPP. Joint bidders must appoint an authorised representative and provide a power of attorney. The bidder must identify and justify any confidential information; the bid price and other specified evaluation-related figures may not be designated as trade secrets. No award-scoring details are provided in the supplied documents.
