Compliance requirements
The bidder must confirm that none of the applicable exclusion grounds exist. Exclusion applies where the bidder or relevant management, supervisory or representative persons have been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; unlawful employment of foreign nationals or breaches concerning their employment conditions, including underpayment; unlawful use of child labour or trafficking-related offences; tax, payment or environmental fee arrears; or circumstances where concluding the contract would breach international or government sanctions. Foreign bidders must provide the required criminal-record and tax-authority certificates, or equivalent evidence where such documents are not issued or do not cover all required matters. Participation is limited to entities established in Estonia, another EU Member State, an EEA contracting state or a WTO Government Procurement Agreement member state. Entities established in Russia or Belarus may not participate. The bidder must also comply with the applicable sanctions restriction and may not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, are more than 50% directly or indirectly owned by such persons or entities, or act as their representatives or under their instructions. The bidder must disclose any known conflict of interest or competition advantage arising from involvement in preparing the procurement or from links with the contracting authority. A joint bid requires a power of attorney for the authorised representative.
Qualification criteria and exclusion grounds
The bidder must be registered in its country’s commercial register or an equivalent register where required by law. The bidder and/or its subcontractor must have properly completed, during the 36 months preceding the start of the procurement, at least one similar service contract worth at least EUR 400,000 excluding VAT. The reference service must have included industrial vacuum cleaning of dry and/or bulk materials and high-pressure-water cleaning of apparatus, equipment and/or pipelines. The value of multiple contracts may not be combined. The bidder must submit the completed contract list, including the contract name, client, value excluding VAT, performance period, description of the work and the client’s contact details. The contracting authority may verify the reference with the client. If waste collection or transport is performed, the bidder or the relevant subcontractor must have a valid Waste Management Department registration, environmental permit or other legal authorisation covering the relevant activity in Ida-Viru County and the waste types handled; a copy of the evidence must be submitted. Known subcontractors must be disclosed, including the relevant contract part and its size and nature. Reliance on another entity’s resources requires that entity’s signed commitment or equivalent proof, and an entity whose experience or qualifications are relied upon must personally perform the relevant part of the contract. The bidder must submit the completed price offer form and equipment compliance table. Mandatory equipment quantities may not be below the contracting authority’s minimum quantities, and the offered quantities become part of the framework agreement. The bidder must provide the required technical data and supporting documents. A vacuum excavator is optional; if offered, its required data must be provided. The bid must comply with the procurement documents; any claimed equivalence must be explained and supported by evidence. The successful bidder must maintain commercial general liability insurance throughout the framework agreement, with a minimum limit of EUR 750,000 per insured event, and submit the policy and proof of coverage within five working days after the framework agreement enters into force and before work begins under the first order.
