Compliance requirements

A bidder will be excluded from the procurement procedure if any of the exclusion grounds set out in § 95(1), points 1–5, or § 95(4), points 3, 8, 9 and 11 of the Estonian Public Procurement Act apply to the bidder. The bidder must submit a confirmation that these grounds do not apply. In addition, the bidder must confirm that none of the grounds for disqualification or exclusion specified in section 6.3 of the procurement rules of Eesti Energia AS and its group companies apply to the bidder.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or another equivalent register of its country of establishment, where registration is required under the law of that country. This requirement applies to both lots: Lot 1, covering calendered rubber for vulcanising conveyor belts and power cables and materials for joining and repairing conveyor belts, and Lot 2, covering materials for joining conveyor belts. The contracting authority will verify the details of bidders registered in Estonia. A foreign bidder must provide registration information or evidence where required. The bidder must confirm that it has reviewed the rules and instructions published on the contracting authority’s website and accepts all conditions set out in the contract notice and tender documents. If the bidder is not the manufacturer of the goods offered, it must submit a copy of the original authorisation issued by the manufacturer for marketing the goods in Estonia. The bidder must confirm its readiness, at the contracting authority’s request, to supply materials similar to the contract subject that are not described in the specification; their price will be agreed on the basis of a separate quotation.
