The bidder must confirm that neither it, its management or supervisory board members, nor persons representing or controlling it are subject to exclusion grounds. These include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour and other forms of human trafficking. The bidder must not have outstanding taxes or social security contributions. There must also be no infringements concerning the employment of foreign nationals staying in Estonia without a legal basis, and entering into the contract must not breach an international or Estonian sanction. The bidder must confirm that it will not involve, for more than 10% of the contract value, suppliers or subcontractors who are Russian citizens, residents or entities established in Russia, entities more than 50% directly or indirectly owned by such persons or entities, or representatives or instructed entities of such persons. It must also not use a subcontractor that would have to be replaced because of an exclusion ground. During contract performance, the contracting authority will check first-tier subcontractors.

The procurement concerns the design and construction of a container campus. All qualification and compliance requirements apply to all lots. - For low-voltage works, including their design, the bidder, consortium member or subcontractor must hold, throughout the contract period, a classified-information processing permit issued by the Estonian Internal Security Service at least at CONFIDENTIAL level and a computer-systems accreditation certificate of conformity issued by the Estonian Foreign Intelligence Service at least at the same level. If the permit or certificate expires, a new application must be submitted early enough to prevent any interruption of access rights. - During the 60 months preceding the start of the procurement, the bidder must have properly completed, as main contractor, at least one similar design and construction project. The project must concern the design and construction of a warehouse, accommodation building including a barracks, public building or office building with a closed net floor area of at least 750 m². The design must have been carried out under the same contract at least to working-design level, or under a separate design contract at least to working-design level. - To prove this experience, the bidder must submit confirmation from the client's legal representative or contract contact person that the works were completed to the required extent and properly, and complete Form I in Annex 1 to the tender documents. - The team must include responsible persons with valid professional certificates: a lead project manager or construction project manager at least at Construction Engineer level 6 with building construction and construction management competence; a design manager at least at Chartered Construction Engineer level 7 with building construction and design management competence; a structural design manager at least at Chartered Construction Engineer level 7 with building construction and building-project preparation competence; an electrical-systems construction manager at least at Electrical Engineer level 6 with the required building electrical-installation competence; a heating, ventilation and cooling design manager at least at Chartered HVAC Engineer level 7 with competence in designing indoor-climate systems; and an HVAC construction manager at least at HVAC Engineer level 6 with competence in managing the construction of heating, ventilation and cooling systems. - The person responsible for low-voltage design must hold Security Systems Designer level 6 with competence in designing alarm systems, surveillance systems and fire alarm systems, as well as a classified-information access permit at least at CONFIDENTIAL level. The person organising low-voltage system construction must hold Security Systems Responsible Specialist level 5 with competence in installing and maintaining fire alarm, alarm and surveillance systems, together with the same level of classified-information access. - Persons used for low-voltage design and construction must hold valid engineer-level manufacturer training certificates for InnerRange Integriti and Milestone VMS systems. Certificates or proof of equivalent certification, the required professional certificates and copies of classified-information access permits must be submitted. - If the bidder relies on the resources of another person or subcontractor, it must submit that person's or entity's written and signed consent, a description of the relied-on competence and confirmation of actual participation in contract performance at least to the extent for which the resources are relied upon. The responsible person must also provide a signed confirmation. - A completed price submission must be included with the tender. The tender must comply with all tender-document requirements, conditional tenders are not allowed, and any equivalent solution must be explained and supported with evidence. - In a joint tender, a power of attorney for the consortium members must be submitted. Only justified information may be identified as a trade secret; the tender price and figures related to the award criteria may not be classified as trade secrets.
