Summary

The tender concerns comprehensive modernization of the software of the Integrated Electronic Identification System for Ukraine, including support for electronic identity wallet infrastructure and relying-party registration, as well as implementation of an eIDAS node in accordance with European Union electronic identification requirements. Compliance requirements

The tenderer must confirm that neither it nor its management, supervisory or representative persons are subject to exclusion grounds. These include final convictions within the relevant five-year period or continuing exclusion obligations for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. The tenderer must also confirm that it has no outstanding tax or social security payment obligations, insolvency, bankruptcy, liquidation, creditor arrangement, comparable financial distress, court- or liquidator-controlled assets, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, improper involvement in preparing this procurement, serious or repeated breaches of previous public contracts, or false statements, withheld information, failure to provide required documents or improper attempts to influence the procedure. National exclusion grounds also cover enabling an unlawfully staying foreign national to work, being subject to international or national sanctions, local tax arrears owed in the contracting authority’s location and convictions for tax offences. The tenderer must provide the required declarations and, where applicable, evidence of corrective measures restoring reliability. First-tier subcontractors are checked during contract performance and must submit a European Single Procurement Document; the tenderer must not engage a subcontractor who would have to be replaced under the applicable public procurement rules. The notice states that the tax-debt threshold is EUR 0; under the stated tax rules, a tax-debt certificate is not issued where the debt managed by the same tax authority is below EUR 100 or payment has been deferred.

Qualification criteria and exclusion grounds

The tenderer’s total turnover for the last three completed financial years before the start of the procurement procedure must be at least EUR 100,000 in total. The tenderer must provide references for at least 2 similar contracts duly completed within the 36 months preceding the start of the procurement procedure. Each contract must have lasted at least 6 months and concerned the development, modernization, adaptation, updating, technical support or maintenance of a public authority’s electronic identification system or an electronic identification subsystem of an information and communication system. Each contract must have had a total value of at least EUR 30,000. The tenderer must submit the required reference details, including the description, value, period, contracting authority and contact details. The tender must include a completed application form and an Accessibility Conformance Statement, or an equivalent description of measures taken to ensure accessibility as required by the technical requirements. Economic operators, including entities whose capacities are relied upon, established or resident in the Russian Federation or Belarus may not participate. The tenderer must meet the requirement in clause 5.3 of the tender requirements and submit an English-language certificate confirming that it is not subject to applicable personal or special economic restrictive measures or sanctions. The tender must comply with the procurement documents, follow the specified price structure and include explanations and evidence of equivalence where necessary. Conditional tenders are not permitted.
