Compliance requirements
The tenderer must confirm that neither it nor its representatives or members of its management or supervisory bodies has received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The tenderer must also have no breaches concerning the payment of taxes or social security contributions, bankruptcy, insolvency or liquidation proceedings, an agreement with creditors, assets administered by a liquidator or court, or suspended business activities.
Possible exclusion grounds also include breaches of environmental, social or labour law, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious breaches or early termination of previous contracts, false statements, failure to provide required information or documents, and improper influence on the procurement procedure. The contracting authority also checks unlawful employment of foreign nationals, international sanctions, local tax arrears and convictions for tax offences. Where an exclusion ground exists, the tenderer may submit evidence of remedial measures restoring its reliability where permitted by the tender documents.
Qualification criteria and exclusion grounds
The tenderer’s total turnover for the last three financial years completed before the start of the procurement procedure must be at least EUR 100,000 in total. The turnover must be declared in the European Single Procurement Document and substantiated where required.
The tenderer must have at least 2 properly completed similar contracts performed within the 36 months preceding the start of the procurement procedure. Each similar contract must have lasted at least 6 months, cover services for the development, modernisation, adaptation, updating, technical support or maintenance of public authorities’ electronic identification systems or electronic identification subsystems of information and communication systems, and have a total value of at least EUR 30,000 per contract. The tenderer must provide the contract description, value, performance period, contracting authority and contact details, and its area of responsibility.
The tender must include a duly completed application form and an accessibility conformance statement in English, or an equivalent description of the measures specified in the technical requirements. The tenderer must also submit, in English and in free form, a certificate confirming that it is not subject to personal, economic or other restrictive sanctions under the Ukrainian sanctions legislation, decisions of international organisations or the specified states. Entities resident or registered in the Russian Federation or the Republic of Belarus, and tenderers relying on the capacities of such entities, may not participate.
