Compliance requirements
The bidder must confirm that none of the applicable exclusion grounds exists. These include final convictions within the relevant period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of trafficking in human beings. The bidder must also confirm that it has no tax or social security payment arrears, or that any obligations have been fulfilled or covered by a binding payment arrangement. Further grounds concern agreements with creditors, bankruptcy, insolvency or liquidation proceedings, assets administered by a liquidator or court, suspended business activities, serious professional misconduct, agreements intended to distort competition, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of earlier public contracts, and the submission of false or omitted information or failure to provide required documents. The bidder must also confirm compliance with national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where permitted, the bidder may provide information about measures taken to restore its reliability. The bidder must additionally declare that it will not use subcontractors or suppliers representing more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, entities more than 50% owned by such persons or entities, or representatives acting on their instructions. A tender may be rejected if awarding the contract would breach the applicable sanctions rules.
Qualification criteria and exclusion grounds
The bidder must hold a wholesale licence for human medicinal products; the contracting authority will verify the licence in the relevant register. The bidder must submit the completed tender form, including both required tables, and provide the price information in the structure specified in the price and evaluable indicators sheet. The tender must comply with all procurement documents and may not be conditional. Where an equivalent product or solution is offered, the bidder must explain the equivalence and provide supporting evidence. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must also confirm that the offered goods are not subject to international sanctions and are not sourced from sanctioned regions.
