Compliance requirements
The bidder must declare whether it, or any person in its management, governing or supervisory bodies or with authority to represent, decide for or control it, has relevant final convictions within the past five years, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking offences. It must also disclose breaches of tax or social-security payment obligations; the notice records a zero threshold and explains that, under Estonian rules, tax-debt certificates are not issued for debts below EUR 100 or where payment has been rescheduled. Foreign bidders are assessed under the rules of their country of establishment.
Other grounds include breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, creditor arrangements, similar proceedings, asset administration by a liquidator or court, or suspension of business; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unpreventable competitive advantage; and significant or repeated failures under previous public contracts resulting in early termination, damages, price reduction or penalties. Grounds also cover false or misleading information, failure to provide required information or documents, attempts to improperly influence the authority or obtain confidential information, enabling illegal employment of a foreign national, relevant tax offences, international or government sanctions, and any applicable restriction on the bidder’s country of establishment. Where legally available, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The service provider must hold accreditation issued by the International Air Transport Association (IATA), or equivalent accreditation, by the time the framework agreement is signed and throughout its term. The bidder must provide an initial confirmation and may provide its IATA code with the tender; the authority will verify the accreditation before signing the agreement.
The bidder must provide free, round-the-clock customer support in Estonian, including on weekends and public holidays, with access to booking systems, and provide a support telephone number. The service must include round-the-clock assistance with travel disruptions, rapid handling of urgent requests, and arranging and issuing travel insurance and visas. When booking services, the provider must seek to avoid requiring the customer to use an employee’s or employer’s credit card as an additional guarantee; if the supplier of an intermediary service requires one, the provider must offer its own card or notify the customer in good time.
On request and where destination conditions allow, accommodation options should be offered that follow an environmental policy, set environmental objectives and meet relevant ecolabel criteria. On request, the provider must report the main transport mode used for trips, distance travelled and greenhouse-gas emissions in CO2 equivalent, including retroactive information by person or organisation for the period requested. Emissions information must be based on the transport provider’s data and the Greenhouse Gas Protocol or equivalent methodology or standards.
The tender must follow the pricing structure specified in the pricing schedule, and submission confirms acceptance of all procurement-document requirements; conditional tenders are not permitted. Joint bidders must appoint an authorised representative and include a power of attorney. The bidder must identify any information claimed as a trade secret and explain why; prices and other numerical indicators used in evaluating service tenders cannot be designated as trade secrets. The bidder must provide the names and personal identification codes of authorised persons not shown in the commercial register, or confirm that there are none. The selected documents do not specify a scoring formula or award-criteria weighting.
The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act as their representative or on their instructions.
