Compliance requirements
The bidder must declare whether exclusion grounds apply to it or to relevant representatives. These include convictions for criminal offences such as participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, human trafficking or unlawful child labour; tax or social security payment arrears; bankruptcy, insolvency, liquidation or suspended business activities; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement; serious or repeated breaches of earlier contracts; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information improperly. National grounds also cover enabling unlawful employment of foreign nationals, international sanctions, tax offences, local tax arrears where applicable, and restrictions on participation based on the bidder’s place of establishment. The bidder may be asked to provide supporting information, and may describe remedial measures where permitted.
Qualification criteria and exclusion grounds
The machine-readable notice and the provided bidder-passport text do not specify precise financial, experience, staffing, registration or certification thresholds; these must be checked in the official tender documents. The bidder must confirm that its offer complies with the procurement documents, is unconditional, and follows the prescribed price structure. It must identify the proposed software and undertake to provide the licence service, including licences, training, hosting and maintenance, in accordance with the tender documents and technical specification. If the software includes machine-learning or artificial-intelligence components, they must be switchable on and off, and the software must still meet the technical specification when those components are disabled. For a joint bid, the bidders must appoint an authorised representative and include the relevant power of attorney. The bidder must identify any persons authorised to represent, direct or control it who are not recorded in the commercial register, providing their names, personal identification numbers and basis of representation. Any information claimed as a trade secret must be identified and the claim justified; bid prices and specified evaluation-related figures may not be treated as trade secrets. Where equivalence is relied on, the bidder must explain it and provide supporting evidence. The bidder must also confirm that the offered goods are not subject to international sanctions and that no corrupt conduct has occurred in connection with the procurement.
