Compliance requirements
The bidder must declare whether it or its management, supervisory or representative persons have relevant convictions within the preceding five years, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspension of business or similar situations; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot otherwise be addressed; involvement in preparing the procurement that creates an unremedied competitive advantage; and serious or repeated failures under previous contracts, including early termination, damages or penalties.
Further grounds include submitting false or misleading information, withholding required information or documents, improperly seeking confidential information, enabling unlawful employment of a foreign national, being subject to applicable international sanctions, and relevant tax-related offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have completed at least one contract during the 36 months preceding the start of the procurement. The contract must have covered an area of at least 500 m² and involved construction of an urban street or road, including asphalt surfacing, installation of street-lighting poles, landscaping, and maintenance of landscaped areas. The bidder must provide a description, value, performance period, and details of the other contracting party, including a contact person’s telephone number and email address; for public contracts, the reference number must also be given. The contracting authority may request client confirmations of proper performance and may contact the clients named.
The person responsible for managing the construction works must hold at least a road engineer qualification at EKR/EQF level 6, excluding an initial qualification, or an equivalent qualification. The bidder must identify this person and provide qualification evidence if requested.
The bidder must engage a person responsible for the quality of planting work and planting stock and for proper execution of planting works. This person must hold either a gardener qualification at EKR/EQF level 4 with the selected competence “establishing and maintaining planting areas”, or a landscape construction worker qualification at EKR/EQF level 4 with the selected competences “establishing planting areas” and “maintaining gardens and green areas”, or an equivalent qualification. The named specialists must be used during contract performance. A replacement requires the contracting authority’s consent and must meet the same requirements.
The contractor must maintain liability insurance throughout the works, with an insured amount at least twice the total contract price, and submit the policy to the client before contract signature.
The bid must comply with the tender documents and must not be conditional. Joint bidders must appoint an authorised representative and include the power of attorney. The bid price must follow the prescribed structure, be submitted in euros excluding VAT with unit prices to two decimal places, and use the Appendix 2 price form. Every line of Appendix 2 must be completed without changes or added conditions; the price must include all costs necessary for proper performance. Zero or negative unit prices are not permitted. Any proposed equivalence to a specified requirement must be explained and supported by evidence.
The bidder must identify, by name and personal identification code, any persons representing, controlling, or making decisions for the bidder or its subcontractors who are not visible to the contracting authority in the relevant register, or confirm that there are no such persons. The bidder must also confirm that it and persons acting on its behalf have not engaged in corruption in this procurement, and that any goods offered are not subject to international sanctions and do not originate from sanctioned regions. The bid must identify any claimed trade secrets and explain the designation; the bid price and evaluation-related numerical figures may not be treated as trade secrets. No specific award-scoring details are given in the supplied documents; check the official tender documents.
