Compliance requirements
The bidder must confirm that the company, its management or supervisory board members, and persons representing or controlling it have not received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour or human trafficking-related conduct. The bidder must also have no outstanding taxes or social security contributions, subject to the lawful exceptions described in the European Single Procurement Document, and must not have enabled the unlawful employment of foreign nationals. The bidder must confirm that awarding the contract would not breach international or Estonian sanctions. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate. Where an exclusion ground applies, the contracting authority may, where permitted, assess measures taken to restore the bidder’s reliability.
Qualification criteria and exclusion grounds
The bidder must have an information security management system compliant with ISO 27001 or an equivalent system. Equivalence may be demonstrated by confirmation from an independent audit firm or accredited certification body; upon request, the bidder must provide a copy of the ISO 27001 certificate or other evidence of compliance. The bidder must be the equipment manufacturer’s official sales and support partner in Estonia, including for maintenance, and must submit the manufacturer’s confirmation. The team must include at least two specialists holding technical certificates issued by the access-point manufacturer; the bidder must provide the relevant confirmations and copies of the certificates. The bid must include a technical solution meeting the requirements of Annex 1 to the tender documents. The bidder must confirm compliance with all tender documents and explain and substantiate equivalence where applicable. In a joint bid, a power of attorney from the joint bidders must be included. Conditional bids are not permitted. The bidder must identify any trade secrets and justify that designation; the bid price and prohibited numerical indicators relevant to evaluation may not be classified as trade secrets. The bidder may not use subcontractors or suppliers involving Russian persons or entities for more than 10% of the contract value, or rely on such entities’ capacities to meet the qualification requirements.
