Compliance requirements
The tenderer must declare that none of the applicable exclusion grounds exists. These include final convictions within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Exclusion may also result from unpaid taxes or social security contributions; the stated threshold is EUR 0, while the notice explains that a tax-debt certificate is not issued in Estonia where the debt is below EUR 100 or payment has been deferred. Other grounds include breaches of environmental, social or labour-law obligations, bankruptcy, insolvency or liquidation proceedings, an agreement with creditors, comparable insolvency situations, administration of assets by a liquidator or court, suspended business activity, serious professional misconduct, anti-competitive agreements, an unresolvable conflict of interest, improper involvement in preparing the procurement, serious or repeated failures under previous public contracts resulting in early termination, compensation or comparable sanctions, and false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procedure. National exclusion grounds also cover enabling an unlawfully staying foreign national to work, being subject to international sanctions, and convictions for tax offences. Where permitted by law and the procurement documents, the tenderer may provide evidence of remedial measures demonstrating restored reliability.
Qualification criteria and exclusion grounds
The tenderer must be entered in the relevant business register in accordance with the law of its country of establishment. This requirement applies to all 19 lots. The tenderer must also confirm compliance with the procurement documents and submit an unconditional bid. For the relevant lot, the tenderer must have, or have the right to use by the start of contract performance, the required basic snow-removal equipment located in the area where snow removal is performed or within 5 km of that area. The tenderer must submit the snow-removal equipment list using the required document form. Equipment storage must be arranged on property owned by the tenderer or used under a lease. If another person’s property is used, the tenderer must submit a freely prepared lease agreement for that property. The bid price must be submitted in the structure specified in the sheet containing the evaluation criteria and evaluated figures. The machine-readable notice does not specify the exact technical characteristics of the minimum equipment; these must be checked in the tender documents and technical specifications.
