Compliance requirements
The bidder and its representatives, management or supervisory board members must not have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The checks also cover other offences specified in the Public Procurement Act and enabling an unlawfully staying foreign national to work.
The bidder must not have unpaid taxes or social security contributions. Grounds for exclusion may also include bankruptcy, liquidation or another insolvency proceeding, an arrangement with creditors, suspended business activities, serious professional misconduct, anti-competitive agreements, a conflict of interest, or a material breach of previous public contracts resulting in early termination, compensation or another sanction.
The bidder must not provide false information, fail to submit required information or documents, attempt to improperly influence the contracting authority, or seek confidential information for an unjustified advantage. Breaches of environmental, social and labour-law obligations, as well as the application of international or Estonian sanctions, are also relevant. For certain grounds for exclusion, the bidder may provide evidence of remedial measures restoring its reliability where this is permitted by the applicable law and tender conditions.
Qualification criteria and exclusion grounds
The bidder’s average annual turnover for the period 1 January 2023 to 31 December 2025 must be at least EUR 1,000,000. During the 36 months preceding the commencement of the procurement, the bidder must have completed at least three contracts for the sale or rental of computers. Each contract must have a value of at least EUR 100,000 including VAT per year. The references must state the contract subject, performance period and place, and the contracting authority’s name, contact person and telephone number.
The bidder must confirm that the tender complies with the procurement documents and submit the price in the required structure. Conditional tenders are not permitted. A completed technical description meeting the contracting authority’s technical requirements must be submitted; the technical documentation must be in Estonian or English.
The bidder must be prepared to provide samples of the proposed computers at its own expense within 14 working days after receiving the contracting authority’s request. The equipment manufacturer’s authorised service centre must be located in Tartu. The warranty must be valid for at least two years from delivery, cover repairs and a replacement product during warranty repairs, and include battery defects.
The bidder must arrange reuse and recycling of equipment removed from use in accordance with Directive 2012/19/EU. If the bidder is not a member of a producer responsibility organisation, it must provide either evidence of cooperation with a licensed waste operator or an environmental permit for the waste sector. The tender must describe collection, confidential handling and deletion of data carriers, and dismantling for recycling and disposal. The bidder must also confirm that batteries are neither glued nor soldered, provide battery replacement instructions, and ensure the availability of spare parts for at least three years from the conclusion of the sales contract. In a joint tender, a power of attorney for the joint bidders must be submitted.
