Compliance requirements

The bidder and any joint bidder must confirm that none of the exclusion grounds under the referenced provisions of § 95(1) of the Public Procurement Act apply. The bidder or joint bidder must not be bankrupt, in liquidation, subject to insolvency proceedings, have suspended business activities or be in an equivalent situation under the law of its country of establishment. There must be no outstanding state, tax, payment, environmental charge or social security contribution debt. The bidder must confirm that the average remuneration of its employees during the reference period exceeded 70% of the average remuneration in the relevant field for the same period and must prove this with an extract from the Estonian Tax and Customs Board. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. The beneficiary will check the exclusion grounds for the successful bidder, with the detailed procedure set out in the procurement documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the Estonian register of economic activities for construction, covering general construction, indoor climate systems, and internal or associated water supply and sewerage systems. For electrical works, the bidder must also be registered for construction and installation of electrical installations. These registration requirements do not apply to foreign bidders, who must provide equivalent evidence where relevant. The net turnover in the financial year preceding submission of the tender must be at least EUR 2,112,904. By the date of signing the construction contract, the bidder must be able to provide an on-demand guarantee issued by a credit institution, financial institution or insurer for 5% of the construction contract price excluding VAT. If the guarantee is not provided before signing, it must be submitted within 10 calendar days after signing and must remain valid throughout the construction period; an equivalent deposit is also accepted under the stated conditions. During the 60 months preceding the start of the procurement procedure, the bidder must have completed at least one equivalent construction project worth at least EUR 528,226. The reference must concern construction as the main contractor involving the construction, extension or full reconstruction of a building, including load-bearing structures and external envelopes, heat-recovery mechanical ventilation, and a new or reconstructed heating system. The bidder must provide the building details, performance period, value and description of the included works. The team must include a project manager with the required level 6 building engineer or construction manager qualification; a site manager with at least level 5 construction foreman qualification for general construction; a heating, ventilation and cooling specialist with the required level 6 qualification or equivalent; a water supply and sewerage specialist with the required level 6 qualification or equivalent; and a person performing electrical works with at least a class B competence certificate or a level 6 electrical engineer qualification. The stated names and certificate or competence certificate numbers must be submitted. The team must also include an authorised level 7 architect, or an equivalent foreign-qualified person, responsible for the building project’s compliance with the New European Bauhaus requirements. The bidder must have a construction-sector quality management system meeting at least EVS-EN ISO 9001 or equivalent requirements and an environmental management system meeting at least EVS-EN ISO 14001 or equivalent requirements. Copies of the certificates or equivalent evidence must be provided.
