Compliance requirements
The bidder must declare whether it or any person with management, supervisory or representative powers has, within the relevant period, been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The bidder must also declare whether it has breached tax or social security contribution obligations; environmental, social or labour-law obligations; or professional conduct rules, or has committed serious professional misconduct or entered into agreements intended to distort competition.
Declarations are also required concerning insolvency, liquidation, bankruptcy, arrangements with creditors, comparable proceedings, assets managed by a liquidator or court, and suspension of business activities. The bidder must disclose any relevant conflict of interest, involvement in preparing this procurement, serious or repeated breach of an earlier public contract resulting in early termination or sanctions, and any false or misleading information, failure to provide required information or documents, or attempt to obtain confidential information or improperly influence the contracting authority.
National exclusion grounds also cover enabling a foreign national to work without legal grounds or in breach of employment conditions, including payment below the legally required wage; being subject to an international sanction that would make the contract unlawful; conviction for tax offences; any applicable local tax debt at the contracting authority’s location; and lack of a legal right to participate under any bidder-location restrictions set out in the procurement documents. Where an exclusion ground applies, the bidder may provide evidence of measures taken to restore its reliability if the procurement is above the international threshold or the procurement documents allow this. For Estonian tax debts, the notice explains that a debt below EUR 100 or a debt whose payment has been deferred does not result in the tax authority issuing a tax-debt certificate.
Qualification criteria and exclusion grounds
The bidder must have completed at least two contracts during the 36 months preceding the start of the procurement for cleaning indoor spaces intended for public use. Each contract must cover at least 500 m² of cleaning area and include experience using cleaning products bearing the EU Ecolabel for hard-surface cleaning, or another officially recognised or equivalent Type I ecolabel under EN ISO 14024. The bidder must provide details of the contracts, including the area cleaned, performance period, client and client representative’s contact details, and the procurement reference number where applicable. The contracting authority may request client confirmation of proper performance and supporting information within five working days. An ongoing contract may be used if it had been performed for at least 12 consecutive months by the start of the procurement; only work completed during the reference period counts. For framework agreements, completed contracts or orders under the framework may be cited.
The person responsible for delivering the service must hold a cleaning-work manager qualification at level 5, or an equivalent qualification at EQF level 5. The same person must serve as cleaning-work manager for all sites. The bidder must also provide, for that manager, a certificate from training completed with an examination, demonstrating at least knowledge level 3 under EVS 914:2020 or an equivalent level.
Before service begins, the bidder must train the staff who will provide the service on environmental matters, including correct dilution and dosing of cleaning products, wastewater disposal and waste sorting, and must subsequently provide evidence stating the date, trainer, participants and topics. During contract performance, the bidder must monitor and record the required environmental indicators for at least one full working day every four months. Records must cover the quantities and dilution rates of cleaning products and their ecolabels, cleaning equipment and reusability, water use and disposal, and the quantity and sorting of solid waste. The bidder must use products according to their instructions, use ecolabelled or equivalent Type I products where possible, minimise disposable cleaning items and water use, reduce solid waste and sort waste.
These monitoring and environmental-performance commitments are not required if the bidder has an ISO 14001-certified or EMAS-registered environmental management system, or an ecolabel for indoor cleaning services whose criteria include reporting and environmental impact reduction targets. In that case, the bidder must provide evidence of the system or the ecolabel certificate.
All cleaning products must meet EU Ecolabel criteria 1 (toxicity to aquatic organisms) and 4 (prohibited and restricted substances) for hard-surface cleaners. The successful bidder must submit a list of the products to be used and compliance evidence within five working days after contract signature. An EU Ecolabel certificate is sufficient for products bearing that label; otherwise, a conformity audit by a conformity assessment body or independent auditor must demonstrate compliance with criteria 1 and 4.
Before submitting a bid, the bidder must visit the E. Vilde and Mati Unt museums and review the A. H. Tammsaare Museum floor plans at one of those museums. The Tammsaare Museum premises cannot be visited because of renovation work. The visit must be arranged in advance by email with the contracting authority’s contact person at maarja@kirjanduskeskus.ee, completed before the bid deadline and confirmed on site by signature. A bid submitted without the required visit may not be considered.
The bid must comply with the procurement documents; conditional bids are not permitted. Prices must follow the prescribed pricing structure, be stated in euros to two decimal places, include all service-related costs and be greater than zero. If submitting jointly, the bidders must appoint an authorised representative and include the relevant power of attorney. The bidder must identify and justify any claimed trade secrets; prices and other specified evaluation-related numerical information may not be classified as trade secrets. The bidder must confirm that any claimed equivalence is explained and supported by evidence.
