Compliance requirements

The bidder must confirm that neither the bidder nor its management, supervisory or representative persons have received a final conviction within the past five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or offences involving child labour or human trafficking. The confirmations also cover payment of taxes and social security contributions. For tax debts, the notice states that a debt below EUR 100 or a rescheduled tax debt is not included in a tax debt certificate. The bidder must not be bankrupt, in liquidation or subject to insolvency proceedings; its assets must not be administered by a liquidator or a court, and its business activities must not be suspended. There must also be no agreement with creditors, serious professional misconduct, an agreement restricting competition, a conflict of interest, improper involvement in preparing the procurement, a material breach of a previous public contract, or the submission of false or incomplete information. Compliance with environmental, social and labour-law obligations is also checked. The bidder must additionally confirm that no national exclusion grounds apply, including enabling an unlawfully present foreign national to work, breach of international or Estonian sanctions, tax offences, or breach of restrictions on participation in the procurement. Where an exclusion ground applies, evidence of remedial measures restoring reliability may be submitted in certain cases. The precise evidence and scope of verification must be checked in the ESPD and the tender documents.

Qualification criteria and exclusion grounds

The bidder’s net turnover in its latest financial year completed before the start of the procurement must be at least EUR 220,000. Joint bidders may aggregate their turnover. If requested, the bidder must submit an extract from the annual report or other evidence of turnover, unless the information concerning an Estonian-registered bidder is publicly available to the contracting authority from a register. If relying on another entity’s turnover, the bidder must submit an ESPD for that entity and the required consent; the relied-on entity is jointly and severally liable with the bidder for the relevant part of the contract. During the 36 months preceding the start of the procurement, the bidder must have completed at least one contract for the sale, installation and/or maintenance of an intelligent transport system. The contract value must have been at least EUR 100,000 excluding VAT. The bidder must provide the contract description, value, performance period, its area of responsibility and the client’s contact details. If requested, the bidder must submit a client confirmation that the contract covered the purchase, installation and/or maintenance of an intelligent transport system. If relying on another entity’s technical or professional capacity, that entity must participate directly in performing the contract at least to the extent in which its capacity is relied upon. The tender must include the completed price breakdown Excel file, with all payment items priced in euros to two decimal places and excluding VAT. The template may not be altered improperly. The bidder must also submit confirmation of the EURO emission standard for N-category trucks and cranes, a manufacturer’s product sheet or other manufacturer document demonstrating the conformity of the traffic-counting equipment, and the required confirmation concerning the personnel performing the work. The personnel performing the contract must meet the experience and competence requirements set out in the technical specification, and supporting evidence must be submitted for approval. Where relevant, explanations and evidence of equivalence must be provided.
