Compliance requirements
The bidder must confirm that neither it, its management, administrative or supervisory body members, nor other authorized persons representing or controlling the company have received a final conviction during the last five years for participation in a criminal organization, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or trafficking-related offences. The exclusion grounds also cover failure to pay taxes or social security contributions, enabling an unlawfully staying foreign national to work, breaches of international or national sanctions, and legal restrictions on participating in the procurement. The bidder must also confirm proper payment of taxes and social security contributions and provide the relevant evidence where required. Where an exclusion ground applies, the bidder may in certain cases submit a description and evidence of measures taken to restore its reliability; the exact applicability must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed at least one contract during the 36 months preceding the start of the procurement under which at least 30 people were accommodated and catered for at the same time. The reference contract had to include dinner, overnight accommodation and breakfast for at least 30 people simultaneously. The bid must provide the contract details, including the signature and completion dates, the name of the other contracting party and its contact details; the contracting authority may verify the information through public databases or with the client. If the bidder relies on the capacity of another company or joint bidder, it must also provide that entity’s details and, where required, its consent and confirmation that it will participate directly in performing the contract. The bid must be unconditional and comply with the tender documents. In a joint bid, a power of attorney for the joint bidders must be included. The price must be submitted in the contracting authority’s unchanged form with all cost items, and the total price excluding VAT in the form must equal the total price submitted in the procurement system. The accommodation address and the details of authorized persons representing the bidder who are not visible in the commercial register, or confirmation that there are no such persons, must also be provided.
