Compliance requirements
The bidder must confirm that neither it nor its administrative, management or supervisory body members, procurists, or other persons with powers of representation or control have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. An existing exclusion obligation imposed by a court decision may also constitute grounds for exclusion.
The bidder must confirm proper payment of taxes and social security contributions. The bidder must also not be in an exclusionary insolvency or liquidation situation, have its assets administered by a liquidator or court, or have its business activities suspended. Other relevant grounds include serious professional misconduct, agreements distorting competition, conflicts of interest, serious breaches of previous contracts, false statements or failure to submit required documents, and improper attempts to influence the procurement procedure.
National exclusion grounds include enabling the employment of an unlawfully staying foreign national, situations involving international sanctions, and convictions for tax offences. Where an exclusion ground applies, the bidder may, to the extent permitted, submit evidence of measures taken to restore its reliability. The bidder must also confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions.
Qualification criteria and exclusion grounds
The bidder must have completed at least two similar computer sales or lease contracts during the 36 months preceding the start of the procurement. Each contract must have a value of at least EUR 40,000 including VAT per year. The references must state the contract value, time and place of performance, and the contracting customer's name, contact person's name and telephone number.
The bid must contain a sufficiently detailed technical description of all proposed computer configurations to fully demonstrate compliance with the requirements and parameters in the technical specification. The bidder must submit the price table in the structure specified by the contracting authority and an indicative payment schedule for the 48-month lease period; the total lease payments in the schedule must equal the amount shown in the price table. Conditional bids are not permitted, and submission of the bid confirms acceptance of the conditions in the tender documents.
The products must have a warranty of at least two years starting upon delivery. The warranty must cover repairs, a replacement product during warranty repairs and battery defects, and must ensure compliance with the contract without additional charges. The bidder must declare REACH Candidate List substances exceeding 0.1% by mass in the complete product and the specified accessories, and submit documents proving the presence or absence of such substances.
The bidder must offer reuse and recycling services for end-of-life equipment in accordance with Directive 2012/19/EU. If the bidder does not use a producer responsibility organisation, it must submit either proof of cooperation with a licensed waste management operator or an environmental permit for waste management, as applicable. The bidder must also describe the collection of equipment, confidential handling and deletion of data carriers, and dismantling for recycling and disposal. In a joint bid, a power of attorney for the joint bidders must be included. Any trade secret must be identified and justified; the bid price may not be classified as a trade secret.
