Compliance requirements

The bidder must confirm that neither the bidder nor any member of its management or supervisory body, procurator or other authorised representative has been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or other forms of human trafficking. The exclusion grounds also cover outstanding tax or social security payment obligations, bankruptcy, liquidation or other insolvency proceedings, suspended business activities, serious professional misconduct, agreements restricting competition, conflicts of interest and material breaches of previous public contracts. They also cover submitting false information, failing to provide required information or additional documents, attempting to improperly influence the contracting authority or seeking confidential information. National exclusion grounds include enabling an unlawfully staying foreign national to work in Estonia, being subject to an international sanction and convictions for tax offences. The threshold for tax and social security debt is EUR 0; however, the tax authority does not issue a tax debt certificate where the debt is below EUR 100 or payment has been deferred. Where an exclusion ground applies, the bidder may, where permitted, provide evidence of remedial measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The submitted procurement passport does not specify concrete turnover, previous experience, staffing or professional qualification requirements; any such requirements must be checked in the tender documents. The bidder must submit a tender in accordance with the tender documents, and conditional tenders are not permitted. The tender price must follow the structure specified in the evaluation sheet. The tender must include a properly completed Annex 2 product specification and price form, including the medicine name, manufacturer and unit price excluding VAT for each lot covered by the tender. The medicines offered must comply with the requirements in the technical description in Annex 1. If an equivalent product is offered, the bidder must explain its equivalence and provide supporting evidence. The tender must state the details of the contract signatory and contract contact person; where an authorised signatory is used, a power of attorney must be attached. In a joint tender, a power of attorney for the joint tenderers must be provided. The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, are more than 50% directly or indirectly owned by such persons or entities, or represent or act on the instructions of such persons or entities. The goods offered must not be subject to international sanctions or originate from sanctioned regions. Any confidential business information must be identified and justified; the tender price and lot prices may not be classified as trade secrets.
