Compliance requirements
The bidder must not be subject to any of the exclusion grounds set out in § 95 subsection 1 points 1–5 or subsection 4 point 12 of the Estonian Public Procurement Act. The bidder must provide a confirmation that these grounds do not apply. If the company has persons authorised to represent, control or make decisions on behalf of the company who are not shown on the commercial register card, the bidder must provide their names and personal identification codes; if no such persons exist, the bidder must provide a corresponding confirmation.
Qualification criteria and exclusion grounds
The bidder’s total net turnover from all business activities must have been at least EUR 60,000 in each of the last three completed financial years. The bidder must provide the turnover figures for those three financial years and, if requested by the contracting authority, the annual accounts or extracts. If the bidder, a consortium member or a relied-on entity is a foreign company, documents enabling verification of this requirement must be submitted.
During the 36 months preceding the start of the procurement, the bidder must have completed 1–3 contracts under which maintenance services for turnstiles, gates and barriers were provided for a total value of at least EUR 20,000 excluding VAT. The bidder must submit the contract list using Annex 6, including the subject matter, contract period, contract value, value of the maintenance services provided during the reference period, and the client’s name and contact details. For services provided under a framework agreement, completed contracts or orders concluded under that framework agreement may be used as evidence.
If relying on another entity’s capacities, the bidder must submit the consent required under Annex 7. For technical or professional capacity, the relied-on entity must participate directly in contract performance at least to the extent of the capacities relied upon; where the bidder relies on another entity’s experience, that entity must also be identified as a subcontractor. Consortium bidders must, where applicable, describe the size and nature of the framework agreement share to be performed by each member and submit the power of attorney required under Annex 8.
The tender must be unconditional and comply with all tender documents. The price must be submitted in the required structure, together with the price form in Annex 3; the total from the form must be entered in the tender price data. Where applicable, explanations and evidence of equivalence must be provided. The bidder must identify any trade secrets and justify their classification, but may not classify the tender price or relevant numerical figures used for evaluation as trade secrets. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. Contract performance must comply with environmental safety requirements, including separate waste collection, recycling where possible, and the use of environmentally friendly equipment where feasible.
