A bidder will be excluded if the company, a member of its administrative, management or supervisory body, its procurist, or a person authorised to represent, decide for or control it has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies in cases involving unlawful employment of foreign nationals, breaches of the conditions for employing a foreign national in Estonia, including payment below the required wage rate, unlawful use of child labour or human trafficking. The bidder must not have outstanding state tax, payment or environmental charge liabilities, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of an earlier public contract, termination of a contract, price reduction, compensation payment or contractual penalty, as well as for submitting false information or failing to submit required information or documents. Companies established in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components originating from or produced in those countries may not be used in the works; the contracting authority may request certificates of origin.

During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the tender. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party's representative and contact details, and reference numbers for public contracts. The contracting authority may also request evidence of proper performance. The team must include a person holding valid switching rights for switching operations in a 0.22–20 kV electricity network. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The person must be registered in Elektrilevi's partner portal before the tender submission deadline or before tenders are opened. The team must also include a person responsible for the work operation, registered in Elektrilevi's partner portal before the tender submission deadline, and a person managing the electrical works who holds valid A-level competence or a qualification corresponding to at least level 6 under the Estonian Vocational Qualifications Act, supported by relevant evidence. The tender must include the required price schedule, the details of the signatory acting under signing authority, the contract-performance contact person's details and, where necessary, a power of attorney. In the case of a joint tender, a power of attorney for the joint tenderers must be submitted.
