Compliance requirements
A bidder may be excluded for relevant final convictions within the previous five years, or while an exclusion period imposed by a conviction remains in force, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Exclusion grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity, or comparable proceedings; serious professional misconduct; agreements with other businesses intended to distort competition; an unresolved conflict of interest or an unfair advantage from involvement in preparing the procurement; significant or repeated failure to perform an earlier public contract resulting in early termination, damages, a price reduction or a penalty; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information; and breaches of environmental, social or labour-law obligations. National grounds also cover enabling the unlawful employment of a foreign national, international sanctions, and convictions for tax offences. The tax-arrears threshold is EUR 0; under Estonian rules, arrears below EUR 100 or arrears whose payment has been deferred are treated as specified in the notice. Where permitted, a bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
No separate financial-capacity, experience or other bidder qualification thresholds are specified in the hankepass. The tender documents set the following submission and compliance requirements:
- Submit the completed participation declaration, the prescribed price form in its supplied format, and the completed technical description and bid form. State the total price for each lot excluding VAT in the required structure; if prices differ between the prescribed form and the procurement system’s price form, the prescribed form will govern.
- Provide manufacturer-issued technical information in Estonian or English for the offered products, such as specifications or a catalogue, to demonstrate compliance. For every offered product, also submit the manufacturer’s declaration of conformity, instructions for use and packaging label, and, where applicable, an EC certificate. If products from the same manufacturer differ only in size, a label for one selected size is sufficient. Submit other documents substantiating compliance and samples as specified in the technical description and bid form.
- Confirm that the bid meets the tender documents. Conditional bids are not permitted. Where an equivalent product or evidence is offered, explain the equivalence and provide supporting evidence.
- For a joint bid, appoint an authorised representative from among the joint bidders and include the power of attorney.
- The bid may receive 2 points if the bidder has a publicly accessible climate or environmental impact reduction objective. Provide a direct public URL. The objective must include at least one commitment to reduce environmental or climate impacts, address a significant environmental impact such as energy use, transport, water use, material circularity or waste, or reduce pollution. A subsidiary relying on its parent company’s objective must explain how it applies to the bidder.
