Compliance requirements
The bidder must confirm that neither the company nor its representatives or controlling persons are subject to exclusion grounds such as final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also confirm compliance with tax and social security payment obligations and absence of relevant environmental, social and labour-law violations, bankruptcy, insolvency or liquidation proceedings, serious professional misconduct, anti-competitive agreements, conflicts of interest, improper involvement in preparing the procurement, serious or repeated failures under previous public contracts, false statements, withheld information or failure to provide requested evidence. National exclusion grounds also cover unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where an exclusion ground applies, the bidder may provide information on remedial measures where permitted by law or the procurement documents.
During contract performance, the bidder may not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in the Russian Federation, entities more than 50% directly or indirectly owned by such persons or entities, or representatives acting on their instructions. Subcontractors and suppliers must be established in Estonia, another EU Member State, an EEA contracting state or a WTO Government Procurement Agreement country.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least two contracts for the development or comprehensive renewal of a web environment during the 36 months preceding the start of the procurement. Each contract must have had a value of at least EUR 60,000 excluding VAT. Taken together, the reference contracts must demonstrate experience in the activities specified in sections 3.2.1–3.2.10 of the technical description. The bidder must provide descriptions, values, dates, clients, contact details and other evidence required in the European Single Procurement Document.
The project team must include a project manager, analyst, web developer and UX/UI designer. The project manager must have at least two years of experience as a project manager in a web development or web renewal project within the previous five years. The analyst must have at least two years of experience in IT development and/or maintenance projects within the previous five years, including analysis of user needs, content structure or information architecture. The web developer must have at least three years of experience in web development and systems architecture within the previous five years, including experience applying information security and data protection requirements. The UX/UI designer must have at least two years of relevant experience within the previous five years. A digitally signed CV prepared by each role holder must be submitted using Annex 4 Forms III–VI.
One person may perform no more than two mandatory roles. If roles are combined, the bidder must explain how all duties will be performed properly and on time, and the person must satisfy the experience requirements for both roles. The team must also have competence in technical architecture, platform solutions, integrations, security, performance, scalability, content management, accessibility, search engine optimisation and testing.
The tender must include a technical solution description of up to five pages, a UX/UI solution concept of up to three pages and a development process work plan of up to three pages. These documents must cover, among other matters, architecture, content management, integrations, security, performance, scalability, maintainability, WCAG-compliant accessibility, data protection, work stages, timetable, cooperation arrangements and risk mitigation.
