Compliance requirements
The bidder must confirm that neither it nor its representatives or members of its management or supervisory bodies have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, unlawful child labour, or human trafficking. Where applicable, the bidder must describe the conviction, the exclusion period, and any measures taken to restore its reliability.
The exclusion grounds also cover unpaid taxes or social security contributions; breaches of environmental, social, or labour-law obligations; bankruptcy, liquidation, insolvency, or similar situations; assets managed by a liquidator or court; suspended business activity; serious professional misconduct; anti-competitive agreements; conflicts of interest; involvement in preparing the procurement; material breaches or early termination of previous contracts; and false information or failure to submit required documents.
The bidder must also confirm that concluding the contract would not breach international or Estonian sanctions, that it is legally entitled to submit a tender, and that no other national exclusion ground specified in the tender documents applies. The required declarations and, where necessary, electronically available evidence must be provided in the ESPD.
Qualification criteria and exclusion grounds
The bidder’s net turnover in the field of computer systems and database administration must have been at least EUR 20,000 in each of the last three financial years completed before the start of the procurement. Compliance must initially be confirmed in the ESPD, and, upon request, the bidder must submit its three latest annual reports, extracts, or other relevant evidence. If relying on another entity’s resources, the bidder must also submit that entity’s ESPD and a joint and several liability undertaking covering the relevant part of the contract.
Within the 36 months preceding the start of the procurement, the bidder must have properly completed at least one maintenance or development contract for an ESRI platform with a value of at least EUR 5,000 excluding VAT. The submission must include the contract details, including value, dates, client name, and contact details. Upon request, the bidder must provide confirmation from the client and any additional explanations or documents within 5 working days.
At least two specialists must be personally assigned to perform the contract. Their experience must be submitted using the contracting authority’s form “Appendix 2 – Bidder’s team”. The tender must comply with the procurement documents, be unconditional, and present the price in the required structure. Where relevant, equivalence must be explained and supporting evidence provided. In a joint tender, a power of attorney for the joint tenderers must be included. Certificates may earn additional tender points, but their absence will not result in rejection.
