Compliance requirements
The bidder must confirm that neither the company nor its management, supervisory-body members, authorised representatives or other controlling persons have a final conviction within the last five years, or a still-applicable exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The relevant tax and social-security contribution obligations must be fulfilled. The stated threshold for tax and social-security debt is EUR 0; under the applicable rules, a tax debt below EUR 100 or a debt subject to a payment schedule may be treated differently when issuing a debt certificate. The bidder must also comply with national exclusion grounds concerning enabling the employment of unlawfully staying foreign nationals, international sanctions, and any restrictions based on the bidder’s country of establishment or residence. Where an exclusion ground applies, the bidder may provide evidence of remedial measures restoring its reliability if permitted for this procurement. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, entities more than 50% directly or indirectly owned by such persons or entities, or representatives or persons acting on their instructions. Qualification criteria and exclusion grounds
The bidder must submit offers in accordance with the required pricing structure and confirm that the offer complies with all tender document requirements; conditional offers are not permitted. A minimum of two lecturers must be included for each relevant lot. For each lecturer, the bidder must submit the prescribed CV, signed by the lecturer, together with copies or extracts of education documents and, where relevant, evidence of authorship of research papers or articles. Supporting documents must clearly identify the lecturer concerned. Additional team members may be used during contract performance only if they meet the applicable requirements. The bidder must be able to arrange online training when required and provide the online learning environment details during contract performance. A detailed training plan based on the contracting authority’s template and draft curriculum must be submitted within 10 working days after contract signature. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must provide details of authorised representatives who are not visible in the commercial register, or confirm that there are none. Subcontractors and suppliers used during contract performance must be established or resident in Estonia, another EU Member State, another EEA contracting state or a country covered by the WTO Government Procurement Agreement. The bidder must follow the required structure for the financial offer and environmental principles when printing or reproducing handouts; supplementary reading should generally be provided through the online learning environment.
