Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded if it or a member of its administrative, management or supervisory body, or a person authorised to represent, make decisions for or control it, has a relevant criminal conviction within the last five years, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include breaches of tax or social security payment obligations; bankruptcy, insolvency, liquidation, suspended business activity or similar situations; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be neutralised; serious or repeated breaches of previous contracts; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information improperly; and breaches of environmental, social or labour obligations. National grounds also cover enabling the unlawful employment of a foreign national, being subject to an international sanction, and certain tax offences. For Estonian tax arrears, the notice states that a tax-debt certificate is not issued where the debt is under EUR 100 or payment has been deferred. Where permitted, the bidder may provide evidence of remedial measures demonstrating restored reliability.

Qualification criteria and exclusion grounds

The bid must accept all procurement-document conditions; conditional bids are not allowed. The bidder must submit the participation application, completed technical-description and price forms, a list of the offered equipment and its components (including software and licences), and technical descriptions and manufacturer documentation sufficient to verify compliance. The bid must also describe the manufacturer's scheduled maintenance frequency, work and time required, and list and price the maintenance parts and consumables to be replaced or used. Evidence must show that the bidder is an authorised representative and/or dealer of the offered products. The bidder must provide at least one medical equipment specialist for the period specified in the framework agreement's special conditions. The specialist must have at least three years' experience maintaining and repairing the equipment and manufacturer training for the offered equipment. Submit the specialist's details and the manufacturer's confirmation of training or willingness to train the specialist. Joint bidders must appoint an authorised representative and include the power of attorney. The bidder must identify any trade secrets and explain that designation; bid prices and specified evaluation-related figures may not be designated as trade secrets. If offering an equivalent product where required, explain equivalence and provide supporting evidence. The bidder must confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, are more than 50% owned by such persons or entities, or act on their behalf or under their direction. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The notice provides no separate financial-capacity threshold or award-scoring details.
