Compliance requirements
The bidder must confirm that neither the company nor its representatives or controlling persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations. Additional national exclusion grounds concern enabling unlawful employment of foreign nationals, being subject to international sanctions, restrictions based on the bidder’s place of establishment or residence, and convictions for tax offences. The bidder must provide the required confirmations and, where relevant, information about the conviction, exclusion period, corrective measures and supporting evidence. The bidder must also confirm that the contract would not breach applicable sanctions.
Qualification criteria and exclusion grounds
For each lot offered, the bidder must submit a draft curriculum for the development programme using the contracting authority’s prescribed template, complete all required fields and provide the requested descriptions. For each lot, the bidder must propose at least two lead trainers and submit their CVs and copies of documents proving their qualifications. The lead trainers must meet the requirements set out in the tender documents; the same trainer may be proposed for both lots if they meet the requirements of both. Replacement or additional lead trainers used during contract performance must meet the same requirements. The bidder must confirm that the offer complies with all tender document conditions, submit an unconditional offer and present the price in the required structure. Where online training may be needed, the bidder must be able to organise it and identify the online learning environment. The bidder must provide a power of attorney for joint tenderers, if applicable, and identify authorised representatives who are not visible in the commercial register, or confirm that there are none. During contract performance, subcontractors and suppliers must be established or resident in Estonia, another EU Member State, an EEA contracting state or a WTO Government Procurement Agreement party, and the bidder must comply with the applicable restriction on Russian subcontractors and suppliers.
