Compliance requirements
The bidder must confirm that none of the exclusion grounds under § 95(1) or (4) of the Estonian Public Procurement Act apply. Where an applicable ground exists, the bidder may rely on remedial measures under § 97 and provide relevant evidence and, if needed, an explanation. Participation is limited to businesses established in an EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement; businesses established elsewhere, including in Russia or Belarus, are excluded. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate in sanctioned regions. First-tier subcontractors are checked for the stated exclusion grounds. The bidder must also confirm that it will not engage subcontractors or suppliers covered by the EU Russia sanctions rule for more than 10% of the contract value, including Russian nationals, residents or entities established in Russia, entities more than 50% owned by them, or persons acting on their behalf or under their direction.
Qualification criteria and exclusion grounds
The bidder’s average net turnover for the last three financial years completed before the procurement began—2023–2025 for calendar-year accounting—must be at least €500,000 per year. If the bidder has operated for less than three years, its average turnover over that operating period must meet the same annual minimum. The buyer may verify turnover using the business register and may request supporting evidence if verification is not possible.
Within the five years before publication of the procurement, the bidder must have completed at least one contract involving the supply and commissioning of a wood or waste sorting line, and at least one contract involving the design and construction of a comparable industrial hall. The comparable hall must have a 15 cm concrete-pour foundation or equivalent, be built of sandwich panels or equivalent material, and have a minimum enclosed net floor area of 400 m². For each reference, provide a description showing how it meets the requirement, the performance period, and the client contact’s name, telephone number and email address.
The team must include a project manager and a site manager, who must be different people. Each must have at least a Level 6 chartered construction engineer qualification or equivalent professional competence. The project manager must also have managed, within the last five years, at least one project involving the design and construction of an industrial or production building of at least 400 m² and the installation and commissioning of technologically related equipment. The site manager must have managed construction of at least one similar building of at least 400 m² within the last five years. Provide the specialists’ names and competence details, and descriptions of the relevant projects with their scale, dates and client contact details. Qualification evidence may be requested if it cannot be verified in a public register. Where the bidder relies on another entity’s resources, submit that entity’s details, signed consent and confirmations concerning its resources and exclusion grounds.
The bid must include a description of the proposed sorting line and industrial hall, completed in the prescribed ‘Requirements for the content of the bid’ form or containing all the information requested in it. The sorting-line description must explain its operating principles and how the technical requirements are met, and include drawings with dimensions and a layout plan. The bid must also include a realistic work schedule, broken down at least by calendar month from contract signature through successful completion, with activities, periods and milestones. Descriptions may be in Estonian or English, but the prescribed form must be completed in Estonian. The offered equipment and products must meet applicable EU requirements and, where required by law, bear CE marking and be supplied with the required conformity documents.
Submit the total price in the specified structure, showing separate amounts for the industrial hall and the sorting line; bids are evaluated on total price. Conditional bids are not permitted, and the bidder must accept the procurement-document requirements. Any claimed equivalence must be explained and supported with evidence. Joint bidders must appoint an authorised representative and provide a power of attorney. If subcontractors are used, provide their details and the scope of their work; subcontractors subject to replacement under the applicable rules may not be engaged. Identify and justify any information claimed as a trade secret; price and evaluation-related figures may not be classified as trade secrets.
