Compliance requirements
The bidder must confirm that the bidder, its management or supervisory board members, and persons authorised to represent or control it have not been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. Compliance with tax and social security payment obligations is also checked.
Possible exclusion grounds also include breaches of environmental, social or labour law obligations; bankruptcy, liquidation or other insolvency situations; assets administered by a liquidator or court; suspended business activities; serious professional misconduct; agreements restricting competition; conflicts of interest; involvement in preparing the procurement; serious breaches of previous public contracts; and the submission of false information or failure to provide required documents. National exclusion grounds are also checked, including facilitating unlawful employment, breaches of international sanctions, tax offences, local tax debt to the City of Tallinn and possible restrictions on participation.
The bidder must provide the required confirmations and, where necessary, additional information and evidence. If an exclusion ground applies, evidence of remedial measures may be submitted where the procurement exceeds the international threshold or the tender documents allow this.
Qualification criteria and exclusion grounds
The bidder must have completed at least one contract for a service similar to the subject of the procurement during the 48 months preceding the start of the procurement, with a value of at least EUR 100,000 excluding VAT. The similar service must involve creating or further developing software, an information system or a system module that processes, visualises, checks, integrates or exchanges machine-readable spatial, model or 3D data. The contract must cover at least one of the following areas: development or implementation of a digital twin or 3D city model; GIS or spatial data solutions; open BIM, including IFC data or information models; automated compliance checking based on spatial data or information models; or integration of a procedure, registry or application environment with spatial, 3D or information-model functionality.
An ongoing contract may also be accepted if the solution has been accepted by the client for production use and at least EUR 100,000 worth of services has been delivered, accepted and paid for. The bidder must provide the contract description, dates, value, scope of responsibility and the client’s contact details. The contracting authority may verify the information with the client and may request missing information or documents within five working days.
The contract team must include at least four roles: a project manager, an information-model and spatial-data specialist, a software analyst and a programmer. One person may perform up to two roles, meaning that at least three individuals must be involved. The bidder must submit CVs for the team members using the form in Annex 3 and evidence of the software analyst’s higher education degree in information science.
The tender must include a substantive description of the work covering the work methodology and IT architecture vision, the activities, sequence and schedule for stages I and II, and the risks and mitigation plan. The tender must follow the required pricing structure; conditional tenders are not allowed; and any equivalence must be explained and supported by evidence where necessary. A power of attorney for joint tenderers must be submitted in the case of a joint tender. The bidder must also identify and justify any trade secrets, but the tender price and required numerical indicators relating to evaluation may not be classified as trade secrets.
