Compliance requirements
The bidder must confirm that neither the bidder nor its management or supervisory body members, representatives or controlling persons have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. The confirmations also cover payment of taxes and social security contributions and compliance with environmental, social and labour-law obligations.
The bidder must not be bankrupt, under liquidation, subject to insolvency proceedings or in a similar situation. Its assets must not be administered by a liquidator or a court, and its business activities must not be suspended. There must also be no serious professional misconduct, anti-competitive agreement, conflict of interest, unjustified involvement in preparing the procurement, or serious or repeated breaches of previous public contracts resulting in early termination, damages or another sanction.
The bidder must confirm that it has not submitted false information, withheld required information or documents, attempted to improperly influence the contracting authority, or sought confidential information. The contracting authority will also check breaches involving the employment of unlawfully staying foreign nationals, international sanctions, tax offences, local tax debt owed in Tallinn and the bidder’s legal right to participate. Enterprises established or resident in the Russian Federation or the Republic of Belarus, and enterprises relying on the resources of such entities, may not participate.
Where applicable, a bidder affected by an exclusion ground may submit evidence of measures taken to restore its reliability. Tax and social security obligations must have been paid, or a binding payment arrangement must have been concluded, including arrangements covering interest and late-payment charges.
Qualification criteria and exclusion grounds
The bidder’s total annual turnover must have been at least EUR 300,000 in each of the last three financial years completed before the procurement started. The information must be provided in the ESPD. If it is not available in public registers, the bidder must, upon request, submit an extract from the annual accounts or other evidence confirming the turnover.
During the 36 months preceding the start of the procurement, the bidder must have completed at least two contracts for information-system development, including additional development work. Each contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must provide a list of the contracts with their values, dates, client details and client contact person, and procurement reference numbers where applicable. A contract completed to the required financial value by the time of tender submission may also be included.
The contract team must include an information systems architect, a programmer and an information systems administrator, each with at least two years of relevant practical experience. Before the contract is signed, the bidder must submit the specialists’ CVs using the form included in the tender documents.
The bidder must hold a valid EVS-EN ISO/IEC 27001 or EN ISO/IEC 27001 information security management system certificate, an equivalent information security management certificate, or an audit report equivalent to a report based on the E-ITS information security management system. Documents proving compliance may be submitted with the tender.
The tender must comply with the tender documents; conditional tenders are not permitted, and the tender price must be submitted using the prescribed structure. Where necessary, equivalence must be explained and supporting evidence provided. In a joint tender, a power of attorney for the joint bidders must be included. The bidder must be able to carry out additional development of the Tallinn real estate register and provide hosting and maintenance services from 1 January 2027 to 31 December 2029. The services include, among other things, using web-accessible support software, performing development, regression, load and stress testing, ensuring the required infrastructure, certificates and licences, providing support and incident resolution, monitoring performance, and regularly updating the software and hardware.
