Compliance requirements
The bidder must confirm that neither the bidder nor any person with management, representation or control powers has been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The exclusion grounds also cover tax or social security arrears, breaches of environmental, social or labour law, bankruptcy or insolvency proceedings, arrangements with creditors, suspended business activity, serious professional misconduct, agreements distorting competition, conflicts of interest, involvement in preparing the procurement that created an advantage, serious breaches of previous public contracts, and the submission of false information or failure to provide required documents. National grounds also include enabling an unlawfully residing foreign national to work, breaches of international sanctions, tax offences, municipal tax debt owed in Tallinn, and statutory restrictions on participation. The bidder must provide the relevant declarations and evidence where required. If an exclusion ground applies, remedial measures may be described where permitted by the applicable law or tender documents.
Qualification criteria and exclusion grounds
Within the 36 months preceding the commencement of the procurement, the bidder must have properly completed at least one contract similar to the subject matter of the tender, or several such contracts, with a combined value of at least EUR 50,000. Similar experience means contracts for business-process analysis and/or the preparation of terms of reference for information systems. The ESPD must include a list of the contracts, their values and dates, the other contracting parties, and the contact details of the client representative; public contracts must also include their reference numbers. The main document uses both VAT-inclusive and VAT-exclusive wording for the EUR 50,000 threshold, so the applicable tax treatment should be verified in the tender documents. The contract must be performed by at least four specialists covering five roles in total. The team members’ details and experience must be submitted using the contracting authority’s team and CV form, together with higher-education evidence where required. A specialist who is not employed directly by the bidder must provide a digitally or handwritten signed confirmation of participation in contract performance. The bid must also include a work plan and schedule describing the activities for the preliminary analysis and preparation of the terms of reference, as well as the methodology and concept for achieving the expected outcome. A joint bid must include an authorisation document for the joint bidders, the price must follow the prescribed structure, and conditional bids are not permitted.
