Compliance requirements
The bidder must confirm that it and its relevant representatives are not subject to exclusion grounds, including final convictions within the applicable period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking; unpaid taxes or social security contributions; and breaches of environmental, social or labour obligations. Other grounds include bankruptcy, insolvency, liquidation or comparable proceedings, suspension of business, serious professional misconduct, anti-competitive agreements, an unmanageable conflict of interest, improper involvement in preparing the procurement, serious or repeated breaches of previous contracts resulting in early termination or penalties, false or misleading information, withholding information or failing to provide requested documents, and attempts to obtain confidential information improperly. National grounds also include enabling a foreign national to work without legal grounds or in breach of employment conditions, being subject to applicable international sanctions, and relevant tax offences. These grounds apply to all lots. Where the applicable rules permit, the bidder may provide evidence of measures taken to restore its reliability. The notice sets the tax and social contribution debt threshold at EUR 0; Estonian tax authorities may not issue a debt certificate where the debt is below EUR 100 or payment has been deferred.
Qualification criteria and exclusion grounds
The requirements apply to all five lots:
- The bidder must hold a valid Community licence under section 39(1) of the Public Transport Act and provide its licence number. A copy must be submitted if requested by the contracting authority.
- The bidder’s average net turnover from all business activities over the last three financial years completed before the procurement began must be at least EUR 60,000. The period specified is 1 January 2023 to 31 December 2025. Annual accounts must be provided on request if they are not publicly available in the Estonian commercial register; otherwise, the bidder must provide other evidence acceptable to the contracting authority.
- The bidder must have at least three years of experience operating public transport routes and provide a list of at least two completed or ongoing passenger transport service contracts. The list must state the customer’s name and contact details, the service, performance dates or period, and contract value. Customer confirmation of proper performance must be provided on request.
- The bidder must have a person responsible for transport who meets the requirements of Articles 4, 6, 8 and 9 of Regulation (EC) No 1071/2009 and the applicable requirements in the bidder’s country of establishment. The bidder must provide the person’s name, professional certificate number and issue date, and supporting evidence of competence on request.
- The bidder must own or have the right to use the buses required for the routes. During the contract, buses used to provide the service must be no more than 15 years old, measured from the vehicle’s registration year recorded on its national public transport register vehicle card. Submit a list giving each bus’s make/model, registration number and date of first registration.
- Submit the total service price excluding VAT in euros using the required price form, and the price per route-kilometre in euros using the designated form. Conditional tenders are not permitted; submission confirms acceptance of the tender-document requirements.
- The person submitting the tender must be authorised to represent the bidder. Foreign bidders must provide an official document from their country of establishment showing the signatory’s authority; where the signatory’s authority is not recorded in the relevant register, provide the required power of attorney. Joint bidders must appoint an authorised representative and submit the required power of attorney and confirmation of joint and several liability.
- The bidder must declare any trade secrets and justify that designation. The tender price and other numerical figures used to evaluate service tenders may not be designated as trade secrets.
