Compliance requirements
The bidder must declare whether the company or its relevant representatives have, within the applicable period, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; agreements intended to distort competition; unmanageable conflicts of interest or involvement in preparing the procurement; early termination or sanctions for serious breaches of previous contracts; false or misleading information, failure to provide requested information or evidence, or improper attempts to obtain confidential information. The notice also identifies national grounds concerning enabling unlawful employment of foreign nationals, international sanctions, tax offences and, where provided for in the tender documents, local tax debts. Where applicable, the bidder may provide evidence of remedial measures to demonstrate its reliability.
Qualification criteria and exclusion grounds
For each of the six lots, the bidder must have properly completed at least two similar contracts during the three years preceding the tender submission deadline. A similar contract must cover the sale and delivery to the customer’s premises of products specified for the relevant lot, with a value at least equal to the bid price for that lot. The bidder must provide a list of at least two contracts, stating the customer’s name, contact person and contact details, contract scope, value and performance period. The contracting authority may verify the information with the customers and may request evidence of delivery, such as handover and acceptance records or customer confirmation.
The bid must comply with the tender documents, and conditional bids are not permitted. Prices must be entered using the structure in the pricing schedule. For a joint bid, the partners must appoint an authorised representative and include their authorisation. The bidder must identify any claimed trade secrets and explain the basis for that designation; prices and other specified evaluation-related figures may not be marked as trade secrets.
