The bidder must confirm that neither the company nor its directors, management or supervisory board members, authorised representatives or controlling persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The notice also covers non-compliance with tax and social security payment obligations, enabling an unlawfully staying foreign national to work, and being subject to an international sanction. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. The bidder must provide the required declarations and, where applicable, details and evidence concerning convictions, exclusion periods, tax or social security debts and corrective measures.

The bidder must be registered in the business register of its country of establishment and, where required, provide registration details or supporting evidence. During the 60 months preceding the deadline for publication of the contract notice, the bidder must have completed at least 2 construction contracts. Each contract must have included the design and construction of a steel-framed building with an area of at least 150 m², and each contract must have had a value of at least EUR 50,000. The tender must include a list of completed projects with their values and brief descriptions of the works, together with the client and contact-person details or other required evidence. In a joint tender, each joint bidder must submit a separate ESPD, appoint an authorised representative, and provide the required power of attorney and confirmation of joint and several liability.
